Articles
Article 1
Purpose. This Decree stipulates principles, regimes and measures regarding price management, aiming to maintain price stability and protect the legitimate rights and interests of business operators and consumers as well as national interests.
Article 2
Price management. Price management refers to the management of commodity prices and service fees by the price management authorities in accordance with the principles and provisions stipulated in this Decree.
Article 3
Interpretation of terms. The terms used in this Decree shall have the following meanings:
- "Price" means the remuneration paid for the purchase or sale of goods or the provision of services, expressed in the form of money, goods, or other benefits. Prices include: prices managed by the state and prices determined by business operators;
- "Maximum price" means the highest price of goods or services at which business operators may conduct purchases, sales, or provision of services;
- "Minimum price" means the lowest price of goods or services at which business operators may purchase goods or services;
- "Price range" means the price of goods or services within a range from the minimum to the maximum at which business operators may conduct purchases, sales, or provision of services;
- "Business operator" means any individual, legal person, or organization, whether domestic or foreign, engaged in the production, sale, purchase for sale, or import for sale of goods, or the provision of services within the Lao People's Democratic Republic;
- "Production" means the making, mixing, processing, assembling, manufacturing, altering the state, altering the form, reforming, selecting, modifying, combining packaging, or turning something into goods by any means, including creating a trade name or commercial mark for such goods, whether done personally or commissioned to others;
- "Sale" means the act of selling, exchanging, giving, distributing, or transferring possession of goods to another person;
- "Goods" means tangible objects for consumption or use, including documents certifying rights to such objects;
- "Service" means the act of providing attendance, providing use, or providing property benefits in exchange for remuneration in money or other benefits;
- "Consumer" means any individual, legal person, or organization that purchases and uses goods and services within the Lao People's Democratic Republic lawfully and without commercial purposes;
- "Price management authority" means a state agency authorized by law to organize and implement price management work;
- "Price control list" means the list of goods and services determined by the price management authority in each period for the application of price control measures;
- "Price fluctuation monitoring list" means the list of goods and services determined by the price management authority in each period for monitoring price fluctuations;
- "Reserve warehouse" means a warehouse or depot established for storing goods included in the price control list;
- "Subsidy" means assistance provided by the state to business operators, directly or indirectly, affecting price levels to achieve price management objectives;
- "Necessity" means the necessity required to maintain price stability, thereby protecting the legitimate rights and interests of business operators, consumers, and state interests;
- "Non-discrimination" means the principle of treating domestic and foreign goods and services equally in price management measures;
- "Transparency" means making price management measures clear and publicly disclosed to society.
