Article 1
Purpose. The purpose of this Agreement is to ensure that organizations responsible for waste management in towns, municipalities, and village clusters nationwide can carry out organized management of the construction, operation, and closure of waste treatment sites in accordance with technical specifications, fully meeting the needs of waste treatment services while safeguarding the protection of public health and the environment.
Article 2
Scope of Application. This Agreement establishes certain necessary principles and norms for the planning, construction, management, and inspection of general waste disposal sites nationwide; secondly, it sets conditions and standards for the siting, design, and construction of waste disposal sites that comply with sanitary principles, and formulates operational plans, operational methods, and closure methods for such sites.
Article 3
Definitions of terms. 1. Waste disposal site management organization refers to a legally authorized entity responsible for and leading the collection and treatment of waste, ensuring compliance with the standards set forth in these regulations. This management organization includes: local administrative authorities, provincial Departments of Transport, Posts, and Construction (provincial-level transport and construction departments), urban development and management agencies, district transport and construction departments, and developing village clusters. 2. Open waste disposal site refers to a site where waste is dumped and treated in a natural manner, without management, without enclosures, allowing free access by humans and animals, failing to safeguard public health, and potentially causing adverse environmental impacts. 3. Controlled waste disposal site is similar to an open waste disposal site but is managed, has enclosures for humans and animals, and undergoes periodic leveling and soil covering in stages to safeguard public health and reduce environmental impacts. 4. Sanitary waste disposal site refers to a waste disposal site that is planned and properly constructed according to standards, managed, equipped with a protection system to prevent human and animal entry, and treats waste through proper soil covering methods to safeguard public health and reduce environmental impacts.
