Article 1
Article 1 Purpose
This Law prescribes principles, regulations, and measures regarding the management, supervision, and inspection of labor skill development work, in order to make such work systematic, robust, efficient, and effective, aiming to equip the labor force with knowledge, abilities, professional proficiency, and work attitudes for engaging in labor, enhance labor skills, increase labor productivity, ensure alignment with the demands of employing units and the labor market, and promote self-employment, enabling integration with the region and the international community, thereby contributing to the national socio-economic development.
Article 2
Article 2 Labor Skills Development
Labor skills development refers to the training and upgrading of the labor force’s skills based on labor skill standards developed and established in accordance with the positions and duties required by employers and the labor market in each occupational field, combined with the potential of the locality and region as well as individual aptitudes, and in line with the actual conditions and circumstances of the country, region, and internationally.
Article 3
Article 3 Interpretation of Terms
The terms used in this Law have the following meanings:
1. Labor force refers to citizens aged between fifteen and sixty years who are capable of engaging in work;
2. Employer refers to an individual, legal entity, or organization that hires workers to work for them and pays wages or labor remuneration and welfare benefits in accordance with the provisions of laws, regulations, and labor contracts;
3. Worker refers to an individual who works under the management and supervision of an employer and receives wages or labor remuneration and welfare benefits from labor in accordance with the provisions of laws, regulations, and labor contracts;
4. Labor skill refers to the ability and proficiency to perform work using knowledge acquired through training, learning, or accumulated experience, and which has been properly tested and certified;
5. Labor productivity refers to the ability to increase output by applying labor skills;
6. Work attitude refers to the morality, diligence, patience, loyalty, hard work, frugality, professional ethics, conduct, discipline, and safety culture demonstrated in work or employment;
7. Labor skill grade refers to the scope of knowledge, ability, and proficiency in work, employment, or labor, as prescribed by labor skill standards at various levels;
8. Work unit refers to a production, trade, or service business unit registered in accordance with the law, as well as various projects in all sectors of the economy and society;
9. Labor market refers to the source of demand and supply of labor in society;
10. Job position refers to the work and duties for which an employer needs to recruit workers based on the actual requirements of the work;
11. Freelance occupation refers to an occupation in which a person engages in self-operated business or commercial activities, utilizing their own ideas, knowledge, abilities, and labor, and involving investment;
12. Freelancer refers to an individual or family that generates income through self-operated business or commercial activities;
13. Tripartite body refers to an organization composed of labor administration authorities, representatives of workers, and representatives of employers;
14. Association refers to a social organization established voluntarily and lawfully, not for profit, for mutual assistance and regular activities to protect the legitimate rights and interests of the association, its members, or the community, such as the Sewing Industry Association, the Hotel and Restaurant Association.
