Article 1
Article 1 Purpose
This Law stipulates principles, regulations, and measures concerning the organization and activities of the People's Procuratorate, enabling this body to perform its duties with efficiency and effectiveness, aiming to protect the interests of the State, society, and collectives, protect the legitimate rights and interests of citizens, ensure that defendants are prosecuted and brought to trial in accordance with the law, and conduct legal supervision over compliance with and implementation of the law in judicial proceedings, contributing to social peace, order, the promotion of the rule of law, and the defense and construction of the country.
Article 2
Article 2 People's Procuratorates
The People's Procuratorate is an organ that initiates public prosecution against defendants for trial and exercises legal supervision over the observance and implementation of laws in judicial proceedings.
Article 3
Article 3 Interpretation of Terms
The terms used in this Law have the following meanings:
1. Personnel of the People's Procuratorate—civil servants, refer to the Procurator-General, Deputy Procurators-General, procurators of the People's Procuratorate, assistant procurators of the People's Procuratorate, legal professionals, administrative personnel, and personnel of military procuratorial organs;
2. Procurators of the People's Procuratorate, refer to persons appointed by the Procurator-General of the Supreme People's Procuratorate, who perform duties of supervision, investigation, and appearance in court in accordance with the law;
3. Assistant procurators of the People's Procuratorate, refer to persons appointed by the Procurator-General of the Supreme People's Procuratorate, who perform duties of assisting procurators of the People's Procuratorate;
4. Personnel of military procuratorial organs, refer to the Procurator-General, Deputy Procurators-General of military procuratorial organs, military procurators, assistant military procurators, legal professionals, and administrative personnel, in accordance with the provisions of the Law on Military Procuratorial Organs;
5. Rule of law, refers to the correct and strict compliance with and enforcement of the law;
6. Decisions, refer to orders, directives, statements, applications for protest, applications for retrial, and other legal documents of the People's Procuratorate;
7. Indictment, refers to the order of the Procurator-General of the People's Procuratorate accusing the defendant and requesting trial by the People's Court;
8. Public prosecution statement, refers to the opinion of a procurator of the People's Procuratorate identifying the criminal conduct of the defendant in court;
9. Detention facility, refers to a place where a suspect is controlled within the statutory time limit in accordance with the law;
10. Custody facility, refers to a place where a defendant or accused is held during the proceedings before the judgment becomes final and binding;
11. Labor reeducation camp, refers to an administrative educational and reform facility;
12. Correctional facility, refers to a place where a convicted person serves a sentence in accordance with a court judgment that has become final and binding.
