Article ມາດຕາ 1

Article 1 (Amended) Mutual Assistance Fund
Mutual Assistance Fund, abbreviated as "ກຊກ", is the pooling of capital by members of the Mutual Assistance Fund to provide assistance when a fund member gives birth, undergoes surgery, retires (if not continuing as a fund member), experiences fire (house burned), relocates to another province or abroad, or dies.

Article 2 Definition of Terms
The terms used in this agreement are defined as follows:

1. Trade union means a broad mass organization in the political system of the people's democratic regime with the Lao People's Revolutionary Party as the core, representing the rights and legitimate interests of trade union members, workers and other laborers;

2. Trade union member means a person who is an employee-civil servant, student, intellectual, in party-state organizations, the Lao Front for National Construction, mass organizations, and other workers and laborers in labor units who have been admitted and registered as a trade union member;

3. Grassroots trade union means a trade union organization established in a grassroots organization or labor unit with more than one hundred trade union members;

4. Sectoral trade union federation means a trade union organization in state and private labor units that has been officially established and has at least one hundred affiliated trade union members;

5. Workers' representative body means the Lao Federation of Trade Unions Central, ministry-level trade union federations, agencies, provincial trade union federations, district trade union federations, municipalities, grassroots trade unions and labor units;

6. Fund means the contribution of fund members on a voluntary and unanimous basis in accordance with the provincial governor's agreement on mutual assistance fund to accumulate financial resources and ensure the implementation of policies towards fund members according to the set objectives;

7. Mutual assistance means the assistance among fund members in case of death, childbirth, surgery, retirement and relocation to another province or abroad;

8. Fund member means a person who voluntarily and actively contributes obligations and receives policies correctly in accordance with this agreement;

9. Policy means the benefits provided to fund members in case of death, childbirth, surgery, retirement and relocation to another province or abroad.

Article 4 State Policy on Mutual Assistance Fund Work
Pursuant to the resolution of the 4th Ordinary Session of the 4th National Assembly, which adopted the Law on Lao Trade Unions (Amended) in Article 40 (new), the Lao Trade Union is permitted to have a mutual assistance fund to pool the capital of fund members to assist each other in times of various difficulties, enabling the trade union organization to fully perform its role, rights and duties in protecting the legitimate rights and interests of workers and other laborers.
