Article ມາດຕາ 1

Article 2 (Amended) Fines and Other Measures
Fines are financial measures applied to administrative violators who do not constitute criminal offenses related to laws and regulations on tobacco control, according to the fine rates stipulated in this decree.
Other measures are measures applied to violators of laws and regulations on tobacco control, including education, warning, detention, seizure, destruction of tobacco products, suspension of business operations or revocation of business licenses, import-export licenses, wholesale and retail licenses.

Article 2 (Amended) Interpretation of Terms

The terms used in this Decree shall have the following meanings:

1. Tobacco products means cigarettes, cigars, pipe tobacco, novel tobacco products, and other types of tobacco that use tobacco leaves as raw material in whole or in part, or contain nicotine as an ingredient, or extracts from tobacco leaves;

2. Novel tobacco products means tobacco products containing nicotine as an ingredient, using electrical energy, such as electronic cigarettes, shisha or baraku, and vaporizing electronic cigarettes;

3. Shisha or baraku means tobacco products that use heat energy to inhale and exhale nicotine vapor mixed in water through a pipe into the mouth or nose;

4. Vaporizing electronic cigarettes means tobacco products that use equipment with an electrical system that generates heat and vaporizes;

5. Receiving, providing sponsorship, support from tobacco companies and operators means all forms of receiving and giving, including cash, loans, prizes, research funds, scholarships, study tours, materials, medical equipment, general office equipment, vehicles, timber, souvenirs, gifts, presents, incentives, and organizing activities that demonstrate social responsibility;

6. Places prohibited from selling tobacco products means places where it is not allowed to distribute, buy, or sell tobacco products, such as public health service places, educational places, sports places, government and private offices, funeral homes, cultural halls, museums, theaters, gymnasiums, cinemas, inside public transport vehicles, religious places, parks, zoos, children's playgrounds, traditional festivals, and various social events.

Article 4 (New) Principles on Fines and Other Measures

The imposition of fines and other measures against violators of laws and regulations on tobacco control must follow the following principles:

1. Be in accordance with laws and regulations;
2. Centralized and unified management within the scope of the whole country;
3. Ensure orderliness, speed, efficiency and effectiveness;
4. Ensure the implementation of fine rates is uniform, correct, transparent, fair and verifiable;
5. Ensure coordination with ministries, agencies, local administrative authorities and other relevant parties.
