Article 2 Import - Export and Transit of Food (Amended)
Import - export and transit of food, food additives, food containers and packaging, including food donation, is the registration, licensing, inspection and monitoring of imported, exported, temporarily imported, temporarily exported, re-exported and transited food, food additives, food containers and packaging.

Article 2 Interpretation of Terms (Amended)
The terms used in this agreement have the following meanings:
1. Food means objects or substances in finished or semi-finished form, including fresh, raw food, for human consumption, including beverages, other beverage products, and any substance used in production, preparation, processing, or formulation, but excluding cosmetics, tobacco, and substances used as medicine;
2. Import-Export means taking food out of or bringing it into the Lao PDR, including temporary import and import for exhibition;
3. Transit means transporting food to a third country through the territory of the Lao PDR;
4. Temporary Import means importing food, food additives for production, transformation, repackaging, transshipment, exhibition, or storage in a warehouse for a certain period, aimed at re-export, not permitted for sale, distribution, and destruction in the Lao PDR;
5. Temporary Export means taking food from the Lao PDR for exhibition, research, testing, scientific research abroad, without sale or transfer of ownership, then returning it to the Lao PDR;
6. Re-export Import means bringing food and food additives into the Lao PDR for temporary stay, transshipment, storage in a warehouse, then re-exporting to a third country, without sale, distribution, and destruction in the Lao PDR;
7. Food Imported for Exhibition means food permitted for import solely for exhibition in quantities as specified in the Law on Customs;
8. Food Additive means a substance added to food for technical purposes, including shape, taste, smell, color, etc., used in the production, preparation, processing, treatment, packaging, transport, and storage of food, which may directly or indirectly affect the specific characteristics of the food;
9. Food Safety Authority means the authority with competence in food safety management as defined in the Law on Food, internationally referred to as: Food Safety Authority;
10. Recognition of Third Party means an organization authorized by the Food Safety Authority of the Lao PDR or the food safety authority of the exporting country to carry out activities related to food safety control;
11. Certification means the official recognition of quality and food safety by the Food Safety Authority or an officially recognized third party;
12. Official Food Testing Laboratory means a food testing laboratory recognized and authorized by the Ministry of Health;
13. Food Donation means the import-export and transit of food to assist people through individuals, legal entities, state organizations, international organizations, and foundations (domestic or foreign), where the donor does not expect profit, obligation, or compensation from the recipient.

Article 4 Scope of Application (Amended)
This Agreement applies to individuals, legal entities, domestic and foreign organizations engaged in the import, export, temporary import, temporary export, re-export and transit of food, food additives, food containers and packaging, including food donation, which does not include the import, export, temporary import, temporary export, re-export and transit of primary agricultural products managed by the agriculture and forestry sector.
