Article 1
Article 1 Purpose
This Law defines principles, regulations, and measures regarding the management and inspection of extradition to ensure its correctness and fairness, in accordance with the laws of the Lao People's Democratic Republic, international regulations, treaties, and international conventions to which the Lao People's Democratic Republic is a party, aiming to combat and prevent crimes, promote effective and practical international cooperation in related fields, and based on mutual respect for independence, sovereignty, territorial integrity, equality, and mutual benefit.
Article 2
Article 2 Extradition
A fugitive (person to be extradited) means a person who is accused or has been sentenced by a court for a criminal offense and has fled into the territory of the Lao People's Democratic Republic, or a person who is accused or has been sentenced by a court within the territory of the Lao People's Democratic Republic and has fled to foreign territory.
Extradition means the transfer of an accused person or an offender by the requested state at the request of the requesting state, for the purpose of conducting criminal proceedings or executing a sentence in the requesting state.
Article 3
Article 3 Interpretation of Terms
The terms used in this Law shall have the following meanings:
1. Requesting State means any State that requests another State to hand over an accused person or offender it is pursuing in order to achieve extradition;
2. Requested State means any State that is requested by another State to extradite a fugitive;
3. Pursued Person (Person Sought for Extradition) means an accused person or offender;
4. Contracting Party means a State, international or regional organization, or other legal entity that voluntarily undertakes commitments under international law to fulfill obligations under an international convention that has entered into force for it;
5. Crime means a criminal offense;
6. Central Coordinating Authority means the agency responsible for coordinating extradition work under treaties to which the Lao People's Democratic Republic is a Contracting Party;
7. Competent Authorities of the Lao People's Democratic Republic means the Ministry of Foreign Affairs, the Ministry of Public Security, the Supreme People's Procuracy, the Supreme People's Court, and the Ministry of Justice.
