Article ມາດຕາ 1

Article 17 General Prohibitions

Individuals, legal entities or organizations are prohibited from the following acts:

1. Encroaching or settling in protected forest areas, reserved forests, reserved water source areas and state reserved zones;

2. Forging land certificates, seals, signatures or other documents related to land;

3. Using land not in accordance with the purpose or the law;

4. Moving, altering or destroying land boundary markers;

5. Buying or selling land use rights illegally;

6. Leasing, exchanging, selling, mortgaging or transferring state land including village collective land illegally;

7. Changing land type and land use purpose without permission;

8. Violating contracts for purchase, sale of land use rights, lease or concession of land, evading payment of rent or land concession fees, natural resource fees, land use fees, taxes, fees and service charges;

9. Using violence or threatening officials or staff;

10. Refusing to cooperate or obstructing the resolution of land disputes;

11. Engaging in other acts that violate the law.

Article 18 Prohibitions for officials and relevant staff

Relevant officials and staff are prohibited from having the following behaviors:

1. Being negligent, careless, or delaying the consideration of land use rights revocation;
2. Performing duties without fairness, with bias, or incorrectly;
3. Abusing power, position, or duties, soliciting, demanding, or accepting bribes;
4. Exceeding the scope of authority, causing damage to the interests of the state, collective, or the legitimate rights and interests of the people or investors, both domestic and foreign;
5. Forging documents, signatures, and seals;
6. Disclosing confidential information without authorization;
7. Destroying evidence and documents related to land use rights revocation;
8. Acting as a broker or advisor to individuals, legal entities, or organizations regarding land use rights revocation work;
9. Engaging in other illegal behaviors.

Article 3 Management and Inspection of Land Use Right Revocation

The Ministry of Agriculture and Environment directly manages and inspects the work of revoking land use rights and proactively coordinates with relevant ministries, organizations, and local administrative committees.

The agencies responsible for managing and inspecting the work of revoking land use rights include:

1. Ministry of Agriculture and Environment;
2. Provincial Agriculture and Environment Department;
3. District Agriculture and Environment Office.
