Article ມາດຕາ 1

Article 2 Collective Management Organization of Copyright

Collective Management Organization of Copyright is an organization of copyright and related rights, established by agreement among authors, copyright owners, and owners of related rights, to protect and manage their copyright and related rights, and to carry out various activities, including negotiating licenses for the use of works, collecting, distributing, and paying royalties, protecting the rights and legal interests of members, and representing them in mediation and litigation.

Article 2 Interpretation of Terms
The terms used in this agreement have the following meanings:

1. “Copyright owner” means the owner of the right, the creator, or a person who has received the transfer of rights or inherited benefits from the creator or inherited the estate, or another person who has received rights under the law;

2. “Owner of related rights” means the owner of the right, performer, producer of sound recordings, broadcaster, or a person who has received the transfer of rights or inherited benefits or inherited the estate, or another person who has received rights under the law;

3. “Royalty or remuneration” means money received from payment for the use of works to be shared among the right holders;

4. “License to establish a collective management organization” means the permission to establish a collective management organization issued by the Department of Intellectual Property, Ministry of Industry and Commerce.

Article 4 Scope of Application
This agreement applies to individuals, legal entities and organizations, both domestic and foreign, that operate and are involved in the work of collective management organizations in the Lao PDR.
