Article ມາດຕາ 1

Article 2 Fines and Application of Other Measures
A fine is a financial measure applied to administrative violators who do not constitute a criminal offense in electronic commerce.
The application of other measures is the application of additional measures beyond fines to administrative violators who do not constitute a criminal offense in electronic commerce, such as warning, education, seizure, attachment, suspension or revocation of recognition certificates and licenses for conducting electronic commerce business.

Article 2 Definition of Terms
The terms used in this agreement have the following meanings:
1. Own electronic channel merchant means a person or legal entity that creates its own electronic channel to advertise and sell goods and services through websites, applications, programs or other instruction sets;
2. Electronic marketplace merchant means a person or legal entity that brings its own goods and services to advertise and sell through the electronic channel of another person or legal entity that provides electronic marketplace services;
3. Electronic marketplace service provider means a person or legal entity that creates an electronic channel such as a website, application, program or other instruction set to enable others to conduct business in such channel by collecting service fees or other remuneration.

Article 3 Scope of Application
This agreement applies to individuals, legal entities, and organizations, both domestic and foreign, who violate decrees and regulations on electronic commerce in the Lao PDR.
