Article ມາດຕາ 1

Article 2 Service Units

Labor safety service unit is a business organization with legal entity status, licensed by the Ministry of Labor and Social Welfare to conduct business in providing services of consultation, training, risk assessment, risk control, elimination of hazardous risks, and carrying out measurements of work standards.

Labor health service unit is a business organization with legal entity status, licensed by the Ministry of Labor and Social Welfare and with the agreement of the Ministry of Public Health, to conduct business in providing health examination services for Lao workers working inside the country, Lao workers going to work abroad, and foreign workers coming to work in the Lao PDR.

Article 3 Interpretation of Terms
The terms used in this agreement have the following meanings:
1. Labor safety means the absence of danger, risk, injury, and physical and mental loss;
2. Labor hygiene means having good hygiene in work, without negative effects on physical and mental health or occupational diseases arising from the work of the worker;
3. Labor health examination service means annual health examination and certification for Lao workers working domestically and foreign workers working in the Lao PDR;
4. Consultation means providing advice on prevention and resolution of problems related to labor safety and health at the workplace, including wearing personal protective equipment during work, using equipment and machinery correctly according to technical specifications;
5. Training means providing knowledge on labor safety and health at the workplace so that workers and employers have the knowledge to prevent dangers that may arise from work;
6. Risk assessment means the process of estimating and grading the likelihood of possible dangers, such as: labor accidents and occupational diseases;
7. Risk control means using various methods to prevent work accidents, such as: preventing dangers from machines, tools and various equipment or the environment at the workplace;
8. Risk elimination means destroying, terminating waste, such as: burning, burying or disposing, including proper storage according to technical principles;
9. Labor safety and health prevention measures means administration, management, service and arrangement in analysis, research, enforcement of laws, regulations and evaluation of the working environment to prevent labor accidents and occupational diseases;
10. Conducting environmental standard measurements at the workplace means measuring concentrations to compare with established standard values, such as: sound, color, light, heat, cold, dust, particulate, odor, smoke, etc.;
11. Labor safety and health diagnosis means conducting analysis of the causes of labor accidents and occupational diseases for use in solving problems based on existing laws and regulations;
12. Specialist means a person with knowledge and expertise in a particular field related to labor safety and health, such as: engineers, nurses, doctors, researchers, etc.

Article 3 State Policy on Occupational Safety and Health Service Units
The State encourages and promotes individuals, legal entities, and various organizations within the country to conduct business in occupational safety and health services, aiming to protect the rights and interests of workers and employers, based on the laws and regulations of the nation.
