Article ມາດຕາ 1

Article 2 State Administrators
State administrators are individuals appointed by the Ministry of Finance to manage state-invested enterprises, comprising the Board of Directors (Chairman, Vice Chairman, and Board members) and the Management Board of state-invested enterprises. State administrators consist of two types:
1. Civil servant administrators are civil servants who meet all the criteria from the Ministry of Finance and relevant ministries;
2. Professional administrators are individuals who are not civil servants but meet all the criteria in qualifications, knowledge, experience, and specialized technical expertise, appointed to represent the government in managing state-invested enterprises, including:
- Internal professionals are personnel within the state-invested enterprise; and
- External professionals or independent professionals are selected through an open recruitment process.

Article 2 Evaluation of State Administrators

Evaluation of state administrators is the assessment of the performance of duties of the Board of Directors and the Director (state administrators) in state-invested enterprises, aimed at evaluating the success in performing duties according to the roles and responsibilities stipulated in regulations, using various indicators, including:

- Content of political quality and revolutionary moral character;
- Content of knowledge, ability, and experience;
- Working methods;
- Leadership;
- Research, formulation, and guidance of the implementation of annual business plans and strategic plans;
- Performance of duties in accordance with laws and regulations;
- Mutual cooperation between the Board of Directors and the Director;
- Cooperation between state administrators and relevant state agencies;
- Participation in the management of state-invested enterprises;
- Business performance and classification of state-invested enterprises.

The targets of evaluation of state administrators are all professional administrators and administrators who are civil servants holding management positions of category two and below.

Article 4 Evaluation Procedure
1. State administrators must proactively answer self-assessment questions in the state investment enterprise management system of the Department of State Investment Enterprise Management and Insurance, with a self-assessment period of 1 month (August 1-31 of each year);
In some cases, the Department of State Investment Enterprise Management and Insurance may notify state administrators to conduct self-assessment in the form of writing self-assessment forms and assessment by committees, then submit to the Department of State Investment Enterprise Management and Insurance;
2. The Department of State Investment Enterprise Management and Insurance shall inspect and re-evaluate the self-assessment results of state administrators, completing by September 30 of each year, and classify according to the scores obtained as follows:
- 75-100 points: classified as Type 1, good
- 50-74 points: classified as Type 2, average
- 01-49 points: classified as Type 3, weak
3. The Department of State Investment Enterprise Management and Insurance shall summarize and report the evaluation results of state administrators to the leadership of the Ministry of Finance, and notify the evaluated state administrators of the results within October of each year.
