Order
On Management and Collection of Forest Rattan (Type: Garcinia)
To: Provincial departments, Public Security-Military Command, and District Chiefs of 5 districts.
- Pursuant to the Law on Local Administration (Amended) No. 68/NA, dated 14 December 2015, Chapter 4, Article 20, on rights and duties of Provincial Governor and Capital Governor;
- Pursuant to the Law on Forestry (Amended) No. 64/NA, dated 13 June 2019;
- Pursuant to the proposal of the Provincial Agriculture and Forestry Office No. 0826/PAFO, dated 29 April 2025.
Banana plantations are seasonal forest products, listed in the forest products list, according to Agreement No. 0279/ dated February 19, 2020, which are forest products of considerable value and high demand from both domestic and foreign markets. Banana plantations produce fruit from April to May every year, and the special feature of bananas is that if they are not harvested in time according to the season, entering the rainy season, the bananas fall to the ground, and when rain falls on them, they become rotten and cannot be used. Therefore, to ensure timely seasonal harvesting management, sustainability, and to avoid extinction harvesting.
The Governor issues an order:
1. Individuals, legal entities, officials, military, police, and businesspeople, both domestic and foreign, are prohibited from entering, operating, collecting, gathering, and buying-selling forest products of the Mak Jong Ban type for business purposes without authorization.
2. Companies authorized to collect, gather, and buy-sell forest products of the Mak Jong Ban type must have an enterprise registration certificate from the Provincial Department of Industry and Commerce, a forest product extraction permit from the Provincial Department of Agriculture and Forestry, and must strictly comply with regulations on the management, collection, and trading of Mak Jong Ban, as follows:
- It is prohibited to collect Mak Jong Ban in a destructive manner, such as cutting down trees, climbing to shake branches, cutting branches, and using wire to strangle the Mak Jong Ban tree to death. If found, legal proceedings will be taken in accordance with the law.
- Licensed companies must collect and purchase benzoin within the permitted village boundaries and consolidate it at points designated by the state;
- It is prohibited to illegally buy or sell benzoin without authorization or without paying the relevant taxes and duties;
- It is prohibited to buy or sell raw benzoin and benzoin that has not naturally fallen (manually harvested benzoin, immature benzoin); if found, legal proceedings will be strictly enforced, detention, and unconditional confiscation of assets;
- It is strictly forbidden to illegally transport benzoin from villages, districts, or provinces without authorization;
- It is forbidden for individuals or groups to enter and conduct surveys and occupy benzoin forest areas without permission from the village and the District Agriculture and Forestry Office.
Instruct the district administration to coordinate with relevant sectors and village authorities to manage within their responsibilities; if violators are found, proceed with legal action according to regulations;
Instruct the Provincial Agriculture and Forestry Department to serve as the focal point in coordinating with relevant sectors to strictly manage the collection, purchase-sale, tax payment, domestic movement, and export of bamboo shoots of the Nark Jong Ban type in accordance with regulations;
5. Instruct companies that have been authorized to sign contracts with the province regarding the management for conservation, restoration, and utilization of forest bamboo shoots of the Nark Jong Ban type in each village area to coordinate with relevant provincial and district departments to continue implementing the said project to achieve the expected results;
All companies that have signed contracts with the province shall not engage in price competition in implementation, ensuring uniformity;
7. All provincial sectoral departments, district administrative organizations, village administrative authorities, ethnic groups, foreigners residing in Attapeu Province, and businesspeople shall acknowledge and jointly participate in the strict implementation of this order to achieve good results;
8. This order replaces Order No. 05/ຈຂອບ, dated April 11, 2024, and takes effect from the date of signing.
