Article 2 Management of Electricity Services, Construction and Installation
Management of electricity services, construction and installation is the application of principles, regulations, conditions and procedures to grant electricity business licenses to individuals, legal entities or organizations with the intention of investing in electricity business operations, including monitoring, inspection, promotion and encouragement of the business operations of electricity business units to ensure that technical activities are in accordance with Lao electricity technical standards, international standards, and that electricity usage is sufficient, safe, economical, efficient and in compliance with the laws and regulations of the Lao PDR.

Article 2 Interpretation of Terms
The terms used in this agreement have the following meanings:
1. Electricity Business License means a document certifying the rights and obligations to engage in electricity activities issued by the Ministry of Energy and Mines to individuals, legal entities or organizations, both domestic and foreign, to conduct electricity business within Oudomxay Province in accordance with laws and regulations;
2. Individual means any person who has registered an enterprise in accordance with the law, such as: having a name, office location, assets and capital, having a systematic management organization, being liable for debts according to the enterprise form, having legal capacity to exercise rights and perform obligations, and being a plaintiff or defendant as prescribed by law;
3. Legal Entity means a business unit that has registered an enterprise in accordance with the law and has complete elements, such as: having a name, office location, assets and capital, having a systematic management organization, being liable for debts according to the enterprise form, having legal capacity to exercise rights and perform obligations, and being a plaintiff or defendant as prescribed by law;
4. Organization means a state, collective or social organization established in accordance with laws and regulations;
5. Domestic Investor means an individual, Lao or foreign legal entity established and operating business in the Lao PDR;
6. Foreign Investor means a foreign legal entity that comes to invest in the Lao PDR;
7. Business Expansion means the addition of electricity activity items from the activities previously authorized for electricity business;
8. Production means the generation of electricity, the production of equipment and electrical components;
9. Distribution means the distribution of electrical energy and the distribution of equipment and electrical components;
10. Electrical Components means poles, wires, bulbs, transformers, etc.;
11. Independent Power Production Business means a power project or electricity business wholly invested by the private sector or in cooperation with a state enterprise for profit, which is independent from the state enterprise that is the main electricity producer and supplier of the province;
12. BOO means Build, Own, Operate;
13. BOT means Build, Operate, Transfer;
14. Kilovolt (kV) means a unit of electrical voltage;
15. Kilowatt (kW) means a unit of electrical power;
16. Office Location means a place used to facilitate and be suitable for conducting electricity business, used as an administrative and management place for conducting electricity business;
17. Service Equipment means tools and measuring instruments used in the conduct of electricity business related to the activities applied for, in order to make the electricity business highly effective, compliant with technical standards and safe;
18. Licensee means the person named in the electricity business license as specified in this agreement.
