Article ມາດຕາ 1

Article 2 Telecommunication and Digital Transformation Development Fund
Telecommunication and Digital Transformation Development Fund, abbreviated as “TDTDF”, in English as “Telecommunication and Digital Transformation Development Fund”, is a state fund established to accumulate and mobilize funds from domestic and foreign sources for use in digital transformation, expansion and development of telecommunication infrastructure to rural areas, remote areas, human resource development, digital database systems, security of the use of digital technology, and promotion of the use of digital technology.

Article 2 Interpretation of Terms

The terms used in this Decree have the following meanings:

1. Telecommunications development means the formulation of policies, human resource development, and expansion of telecommunications infrastructure to ensure service quality in urban areas, reach remote areas, and ensure national security;

2. Digital transformation means the use of digital technology to transform the activities, production, administration, and services of the state and socio-economic development;

3. Digital technology means information and communication technology developed into modern systems to support digital transformation, including cloud systems, platform systems, artificial intelligence, big data, blockchain;

4. Digital government means the use of digital technology in the administration and services of all state sectors;

5. Digital economy means a new economic model that uses digital technology as a tool to drive, enhance efficiency and effectiveness of economic work in the public and private sectors, creating added value for production, trade, and services;

6. Digital society means a society that uses digital technology as a tool to drive, connect, serve, and conduct social life to be more convenient, fast, economical, and of higher quality;

7. Digital infrastructure means information and communication technology infrastructure supporting the creation of digital systems for use in trade, investment, administration, services, and social relations;

8. Digital platform system means any basic system that uses digital technology to create an environment connecting service providers and users, enabling them to use services or conduct any transaction together in a modern way, including online government service platforms, government data collection platforms, result display platforms;

9. Service product means an output created by the Ministry of Technology and Communications using digital technology to provide services to the public sector, private sector, and society at large, including electronic document management systems, remote meeting systems, online discussions, etc.;

10. Telecommunications and internet business unit means a person operating a business providing services as specified in Articles 26 and 27 of the Law on Telecommunications, No. 32/NA, dated 16 November 2020;

11. Postal business unit means a person operating a business providing services as specified in Articles 26 and 27 of the Law on Postal Services, No. 33/NA, dated 16 November 2020.

Article 3 Terms in this law shall be interpreted as follows:

12. Digital business unit means a person who conducts business as stipulated in Article 38 and Article 39 of the Law on Information and Communication Technology, Data and News, No. 02/NA, dated 7 November 2016, and in Article 46 of the Law on Electronic Transactions, No. 31/NA, dated 29 December 2022;

13. Telecommunications and internet security maintenance fee means a service fee arising from the security management of telecommunications and internet service systems, for which the Ministry of Technology and Communications is directly responsible nationwide.
