On Monitoring, Inspection and Taking Measures
Against Violators of Import, Sale of Prohibited Goods of Various Types within Attapeu Province

To: - Provincial Department of Industry and Commerce,
- Provincial Police Command;
- Provincial Department of Energy and Mines;
- Provincial Department of Natural Resources and Environment;
- Provincial Department of Agriculture and Forestry;
- 05 District Administrations.

- Pursuant to the Law on Local Administration No. 68/NA, dated December 14, 2015,
Chapter 4, Article 20 on Rights and Duties of Provincial Governors and Capital City Mayors;
Pursuant to Decree No. 508/ລບ, dated December 4, 2012, on Trade Inspection.

The Provincial Governor issues an order:

1. Assign the Provincial Department of Industry and Commerce to coordinate with relevant sectors and the administrations of 5 districts to conduct in-depth dissemination of Decree No. 508/ລບ, dated December 4, 2012. All regulations related to prohibitions and measures against violators, as well as the trading of various prohibited goods within Attapeu Province, including: modified equipment, fish guns, electric fishing machines, fish bombs, fish suction devices, mineral suction pumps, gold pans, acids and alkalis, explosives, detonators, pesticides, and other prohibited goods, to the multi-ethnic people, traders, and business operators.
Domestic and foreign entrepreneurs conducting business residing in Attapeu Province, in order to build awareness and consciousness in respecting laws and regulations, as well as to prevent violations of laws and regulations, aimed at promoting and protecting business units that operate correctly in accordance with laws and regulations and in line with the state-regulated market economy mechanism:

2. Assign the Provincial Department of Industry and Commerce to take the lead in drafting an agreement to appoint the Provincial Trade Inspection Committee, coordinating with district trade inspection officials in organizing the implementation of the said work; to monitor and inspect shops in and out of markets, warehouses, operators, domestic and foreign entrepreneurs, applying measures against violators in the distribution, purchase and sale of goods.

3. In case of finding violators, take action against the violator according to Article 21 on fine measures and
additional penalty measures according to the Agreement of the Minister of Industry and Commerce No. 1499/MOIC, dated September 8, 2017, on the implementation of trade inspection work as follows:

3.1. The first violation shall be subject to education, warning, written record, and
fine of 70% of the value of the goods. The goods shall be seized, confiscated, and must be executed
Fully fulfill all obligations in accordance with laws and regulations;

3.2. Intentional violation or second violation shall be fined 100% of the value of the goods, and the said goods shall be confiscated and seized, and all obligations must be fully fulfilled in accordance with laws and regulations;

3.3. In case of repeated violation (habitual offender), a fine of twice the amount of the last fine shall be imposed. At the same time, suspend and revoke the business registration certificate (for offending individuals or legal entities, the provincial military force and provincial police shall be assigned to strictly implement measures according to laws and regulations).

4. Assign the Provincial Department of Industry and Commerce, Provincial Police Command, Provincial Military Force, Provincial Department of Energy and Mines, Provincial Department of Natural Resources and Environment, Provincial Department of Agriculture and Forestry, Provincial Department of Finance, Provincial Department of Information, Culture and Tourism, District Office of Industry and Commerce, District Police Command, District Military Force, District Office of Energy and Mines, District Office of Natural Resources and Environment, District Office of Agriculture and Forestry, District Office of Finance, District Office of Information, Culture and Tourism, and relevant local administrative authorities to coordinate and cooperate in organizing the implementation of the above provisions effectively and in accordance with laws and regulations.
Provincial Agriculture and Forestry Office and the administrations of 05 districts, relevant provincial and district sectors (trade inspection officials), acknowledge and jointly implement this order strictly and effectively, and regularly summarize and report the implementation results to the provincial leadership.

5. This order is effective from the date of signing.
