Articles

Article 1

Article 1. Purpose
This Law prescribes principles, regulations, and measures concerning the management, monitoring, and inspection of employment services to systematize, strengthen, and make them efficient and effective, aiming to promote labor force access to employment, self-employment, fair income, improved living standards, and reduced unemployment in accordance with labor market demands, and to enable employers to fill their required vacancies with labor, aligning with regional and international integration and contributing to national socio-economic development.

Article 2

Article 2: Employment Services
Employment services refer to the creation of conditions and provision of conveniences to enable job seekers to obtain opportunities and have choices for entering employment, to be employed in accordance with the demands of the domestic and foreign labor markets, and to engage in self-employment.

Article 3

Article 3 Interpretation of Terms
The terms used in this Law shall have the following meanings:
1. Labor force means citizens aged fourteen years and above who have the willingness and ability to work and need employment;
2. Worker means a person who works under the management and supervision of an employer and receives wages or labor remuneration together with benefits from the labor performed, in accordance with laws, regulations, and the provisions of the labor contract;
3. Employer means an individual, legal entity, or organization that uses workers for its work and is required to pay wages or labor remuneration together with benefits in accordance with laws, regulations, and the provisions of the labor contract;
4. Unemployed person means a person who has no job, is seeking work, and is ready to work;
5. Labor unit means a production, business, or service unit in various economic and social sectors registered in accordance with laws and regulations;
6. Self-employment means business activities carried out by an individual or family to generate income for themselves and their family;
7. Job seeker means an unemployed person or a worker who needs to change jobs;
8. Labor contract means an agreement between a worker and an employer, or between a worker representative and an employer representative, concerning working conditions, wages or labor remuneration, benefits, and other policies;
9. Binding contract means an agreement between a worker and an agency sending labor to work abroad;
10. Tripartite body means an organization composed of employment service management agencies, employer representative agencies, and worker representative agencies;
11. Labor market means the source of demand and supply of labor in society.
