Article ມາດຕາ 1

Article 1 Purpose

This agreement defines the plans, principles, regulations and measures regarding the management and development of the Champasak River and its embankment protection zone, in order to make that area a development zone with maximum benefit and sustainability, in harmony with the topography, permanently protect the riverbank (embankment), conserve the ecosystem of the Champasak River, and be able to cope with future climate change.

Article 2. Chan River and Its Bank Protection Area
Chan River and its bank protection area refer to the area along both sides of the Chan River, with a length of 9.914 kilometers, consisting of: Chan River, bank protection area or steep slope area, embankment, asphalt road boundaries on both sides, 3 public park areas, and various activities surrounding the said area.

The Chan River bank protection area is also designated as a city highlight, and will be developed, utilized, and managed in accordance with the Anouvong District Provincial Municipality Management Regulations (pursuant to the Decision of the Governor of Xaysomboun Province No. 92/ຈຂ.ຊບ, dated September 6, 2016, on the approval of the Anouvong District Provincial Municipality Management Regulations to be effective, sustainable, consistent with the natural landscape and modern culture of the people of Xaysomboun Province).

Article 3 Definition of Terms
The terms used in this agreement shall have the following meanings:

1. Construction activity means the determination of investment projects of the state or private sector that carry out the organization and implementation of construction works such as: survey, construction, repair, expansion, modification, addition, land filling, setting up shops, installing signs, demolition, management, inspection and supervision of water construction projects.

2. Change of natural conditions means the change of bank conditions, ground, water flow path and other ecological conditions in the said area by various human actions such as: digging, dredging, extracting minerals, sand and black soil, filling the bank with earth, rock, pouring concrete, making wharves, driving piles, discharging wastewater, chemical water, sewage and sludge into the water, and by natural changes of the water source.

3. Activities in the river means organizing various activities in the river within the scope of the bank erosion protection area such as: traditional boat racing, tourist boat trips, building rafts, installing water signs, private boats at each water resting pool.

4. Activities on the bank means organizing all types of activities in the three park areas, within the asphalt road on both sides and the flood protection dike (erosion protection dike).

5. Bank erosion protection area or steep slope area means the boundary of the area for construction of bank erosion protection activities, which includes the flood protection dike crest, bank steps, water gates, parks and reserved areas on the bank of the river bank erosion protection area.

6. Flood protection dike area (retaining dike) means the dike for retaining water at each point to hold water as a pool or called a weir.

7. Park means the three park areas in the river bank erosion protection area, which include trees, flowers, lawns, sculptures, fountains, cave areas and various public utility structures.

8. Ecosystem means the interrelationships, both positive and negative, between living things and non-living things that exist in nature.
