Article ມາດຕາ 1
Article 1 Purpose
This Decree defines principles, regulations and measures regarding the management, protection, development and use of protection forests in order to make such work efficient and effective, aiming to prevent all events that may occur or are occurring, to make protection forests abundant, to reduce risks from the impacts of climate change, to improve the livelihoods of the people, in conjunction with promoting nature tourism, contributing to the socio-economic development of the nation in a green and sustainable direction.

Article 2 Protection Forest
Protection forest is forest and forest land designated for the purpose of protecting water sources, riverbanks, roadsides, preventing erosion and soil quality, strategic areas for national defense, maintaining security, preventing natural disasters, protecting the environment, and others.

Article 3 Interpretation of Terms
The terms used in this Decree have the following meanings:
1. Protection forest land means forest land, including rivers, streams, ditches, canals, swamps, ponds, water areas, and others designated by the State as protection forest;
2. Water source means a place where water collects, resides, stays, or flows permanently or temporarily; water sources arise naturally or are man-made, existing on the surface, underground, and in the atmosphere;
3. Watershed means the boundary of land, water area, and all forest areas from the headwater to the river mouth where there is a watershed, and where precipitation flows together into a water source system, such as the Mekong River, Ou River, Ngum River, Theun River, Kading River, Se Bang Fai River, Se Kong River, and other rivers;
4. Reservoir means a water storage system by digging, damming streams or rivers to have sufficient water and store it for ensuring needs in livelihood, agricultural production, stability of the natural environment and society, and others;
5. Headwater forest means protection forest area which is the origin of rivers;
6. Riparian forest means protection forest area along rivers, streams, ditches, ponds, swamps, to prevent scouring, erosion of riverbanks, reduce water flow velocity, and sedimentation into rivers and reservoirs;
7. Roadside forest means protection forest area designated to prevent soil erosion, maintain forest ecosystem along roads, including forests in highway reserve areas;
8. Forest protection agreement means a document defining obligations between the agency managing and inspecting protection forest work and the village administration whose area is within or adjacent to protection forest, certified by the district administration;
9. Mitigation hierarchy means internationally accepted methods to reduce impacts on biodiversity and ecosystem services, consisting of avoidance, minimization, restoration, and offset;
10. Avoidance means avoiding potential impacts from undertaking activities;
11. Minimization means reducing potential impacts to an acceptable level;
12. Restoration means restoring the environment and ecosystem to its original or near-original condition;
13. Offset means compensating for residual impacts through other measures such as creating new protection forest.
