Articles

Article 1

Article 1. Purpose (Amended)
This Law prescribes principles, regulations, and measures concerning the organization, operation, management, and monitoring and inspection of notarial work to ensure the authenticity and legality of notarization, aiming to enhance the rule of law, uphold justice, protect the legitimate rights and interests of individuals, legal entities, and organizations, participate in maintaining social peace and order, and promote the country’s socio-economic development.

Article 2

Article 2 Notarization (Amended)
Notarization refers to the certification by a notarial agency, in accordance with legal provisions or at the request of the parties to a contract or applicants, of the authenticity and legality of contracts and documents.

Article 3

Article 3 Interpretation of Terms (Amended)
The terms used in this Law shall have the following meanings:
1. Applicant refers to an individual, legal entity, or organization that submits a contract or document to a notarial institution for notarization;
2. Original document refers to a written or printed document that serves as the original, with correct content and structure, signed or fingerprinted by the person, or signed and sealed by the organization that issued or published the document; including documents that are engraved, drawn, photographed, recorded, and consistent with the content and structure of the original;
3. Copy refers to a document reproduced, printed, or developed from the original, with correct and clear content and structure, consistent with the original;
4. Notarial institution staff refers to persons recruited and appointed to perform duties at a notarial institution, including the head, deputy head, notary public, and several civil servants assisting in the work;
5. Close relatives refer to relatives of both spouses, namely father, mother, stepfather, stepmother, father-in-law, mother-in-law, maternal grandfather, maternal grandmother, paternal grandfather, paternal grandmother, biological children, stepchildren, adopted children, grandchildren, elder brothers, elder sisters, younger brothers, younger sisters, uncles (paternal), aunts (paternal), uncles (maternal), aunts (maternal), and maternal uncles;
6. Database refers to a dataset established in an electronic system, accessible through various forms and methods.
