Article 2 Foreign Exchange Management on Foreign Direct Investment
Foreign exchange management on foreign direct investment is the organization and implementation of principles, regulations and measures regarding the opening and use of deposit accounts related to investment, and the inflow and outflow of capital in the Lao PDR, in accordance with the Law on Foreign Exchange Management, the Law on Investment Promotion, the Law on Enterprises and relevant regulations.

Article 2 Interpretation of Terms
The terms used in this agreement have the following meanings:
1. Foreign investor means a foreign individual or legal entity that invests and registers to conduct business in accordance with the laws of the Lao PDR;
2. Foreign direct investment means the bringing of capital into the Lao PDR to conduct business by a foreign investor holding shares from ten percent upwards, in the form of sole investment or joint investment with the state sector, state enterprises or domestic private sector;
3. Investment-related deposit account means a specific deposit account opened with a commercial bank to support financial transactions related to foreign direct investment;
4. Investment preparation deposit account means a deposit account of a foreign individual or legal entity opened with a commercial bank to receive fund transfers during the period of waiting for an investment license and/or enterprise registration certificate;
5. Commercial bank means a commercial bank in the Lao PDR that provides services for opening and conducting transactions related to investment preparation deposit accounts and/or investment-related deposit accounts.

Article 4 Scope of Application
This agreement applies to foreign individuals and legal entities intending to invest in the Lao PDR, foreign investors, and commercial banks.
