Article 1 Purpose
This Decree defines principles, regulations and measures on the management and monitoring of water area land works in order to make such works efficient and effective, aiming at managing, protecting, developing and using water area land sustainably, maintaining the balance of the ecosystem, biodiversity, as well as serving as a place for water quality treatment, reducing floods, droughts, absorbing carbon and adapting to climate change, contributing to the national socio-economic development in a green and sustainable direction.

Article 2 Water Area Land
Water area land is land located on the water surface or within the surrounding area of water sources, lying within other types of land, such as wetlands, ponds or lakes, floodplain grasslands, outflow land, riparian land, mid-water land, depression land, dry or island land, land formed by modification or diversion of water, stagnant or flowing water land, occurring naturally or artificially created, with permanent or temporary characteristics. Article 3 Interpretation of Terms
The terms used in this Decree shall have the following meanings:
1. "Wetland" means marshland, wet soil, flooded grassland, natural ponds with water during the rainy season, and no water during the dry season;
2. "Oxbow lake" means a pond or stream that has changed its flow direction and has water all year round;
3. "Pond or swamp" means an area with water all year round or seasonally, occurring naturally or artificially created;
4. "Riparian land" means land surrounding water sources, such as along rivers, streams, canals, swamps, reservoirs;
5. "Newly formed land" means land resulting from sediment deposition, river diversion or channel change, occurring naturally or artificially, causing temporary or permanent new land in a certain area;
6. "Land in water" means islands, islets, rapids occurring naturally or artificially created;
7. "Peatland" means an important type of soil in wetland areas, organic soil formed from the long-term decomposition of plant remains, brown or black in color, and a carbon sink;
8. "Ramsar Convention" means the international convention on wetlands of international importance, covering five tasks;
9. "Mitigation hierarchy" means an internationally accepted method to reduce impacts from investment projects on biodiversity and ecosystem services, which must apply measures of avoidance, reduction, restoration, and full biodiversity offsetting, aiming at no net loss of biodiversity or net gain of biodiversity;
10. "Full biodiversity offsetting" means actions to compensate for residual negative impacts on biodiversity arising and continuing from a development project after appropriate avoidance, reduction, and restoration measures have been taken;
11. "No net loss of biodiversity" means the outcome from implementing the mitigation hierarchy of a development project, where negative impacts on biodiversity are appropriately balanced by positive impacts on biodiversity;
12. "Net gain of biodiversity" means the outcome from implementing the mitigation hierarchy of a development project, where positive impacts on biodiversity appropriately exceed negative impacts on biodiversity;
13. "Wetland management sector" means the sector that manages the use of each type of land that includes wetland.
