Article 2 Classification of Factory Management Levels
The classification of factory management levels consists of the following 3 levels:
1. Central level: Department of Industry and Handicraft;
2. Provincial level: Provincial and Capital Department of Industry and Commerce;
3. District level: District and City Office of Industry and Commerce.

Article 2 Rights and Obligations of the Department of Industry and Handicraft
The Department of Industry and Handicraft has the following rights and obligations:
1. Research, formulate and improve policies and regulations on factory management work for submission to higher levels for consideration;
2. Disseminate, publicize this agreement, policies and regulations related to factory management work to ensure widespread public awareness nationwide;
3. Issue and revoke establishment permits for large factories listed in the list requiring permits, including factories in industrial parks and special economic zones;
4. Issue, suspend and revoke operation certificates, renew and expand large factories, including factories in industrial parks and special economic zones;
5. Issue, suspend and revoke factory establishment permits, operation certificates for manufacturing and/or assembling land vehicles of all sizes, including factories in industrial parks and special economic zones;
6. Certify annual operation plans of large factories and factories assembling land vehicles of all sizes;
7. Issue product certificates for large factories and land vehicle products of all sizes;
8. Issue certificates for waste treatment systems and emissions from large factories as stipulated in relevant laws and regulations;
9. Manage, monitor and inspect technical standards, raw materials, products, safety and hygiene, environment, chemicals and operating conditions of factories of all sizes nationwide;
10. Evaluate, compile and report on operating conditions, factory technical standards, annual operation plans, factory environment, chemicals and statistics of industrial and handicraft factories on a semi-annual and annual basis;
11. Exercise other rights and perform other obligations as stipulated in laws and regulations.

Article 4 Rights and Duties of Provincial, Capital Industry and Commerce Office

The Provincial, Capital Industry and Commerce Office has the following rights and duties:

1. Disseminate, publicize this agreement, policies and regulations related to factory management work to the society widely within its province, capital;

2. Issue and revoke establishment permits for medium and small factories that are in the list of factories requiring establishment permits, including factories in industrial parks and special economic zones, within its province, capital;

3. Issue, suspend and withdraw operation certificates, renew and expand medium-sized factories, including factories in industrial parks and special economic zones, within its province, capital, except for factories manufacturing and/or assembling land vehicles of all sizes;

4. Issue product certificates for medium-sized factories, except for all types of land vehicle products;

5. Certify annual operation plans of medium-sized factories, except for factories assembling land vehicles of all sizes;

6. Issue certificates for treatment and discharge systems of waste from medium-sized factories as stipulated in relevant laws and regulations;

7. Manage, monitor technical standards of factories, raw materials, products, safety, hygiene, factory environment, chemicals and operating conditions of factories of all sizes within its province, capital;

8. Evaluate, summarize and report on operating conditions, factory technical standards, annual operation plans, factory environment, chemicals and factory statistics, then submit to the Department of Industry and Handicraft every six months and annually;

9. Exercise other rights and perform other duties as stipulated in laws and regulations.
