Article 1
Article 1 Purpose (Amended)
This Law prescribes principles, regulations, and measures concerning state inspection to ensure that such work is carried out efficiently and effectively, aiming to make state power transparent and robust, authoritative in managing the state and socio-economic affairs in accordance with the law, protect the interests of the state, collectives, and the lawful rights and interests of citizens, and contribute to the defense and development of the country.
Article 2
Article 2. State Inspection (Amended)
State inspection refers to the activities of state inspection agencies, namely, examining, collecting information and evidence regarding the implementation of policies, laws, regulations, duties, rights, obligations, and responsibilities by organizations and individuals within state agencies, in order to review, evaluate, and assess the performance of the aforementioned work, and to propose solutions and measures, submitting them to the superior organization of the inspected entity for consideration in accordance with the law.
Article 3
Article 3 Interpretation of Terms (Amended)
The terms used in this Law have the following meanings:
1. Complaint refers to a document submitted by an individual, legal entity, or organization to the state inspection agency concerning issues such as state administration, exercise of rights, performance of duties, or responsibilities of officials or organizations violating laws and regulations;
2. Organization refers to ministries, agencies, People’s Courts, People’s Procuratorates, the state audit agency, the Secretariat and Committees of the National Assembly, the Lao Front for National Construction, the Lao Veterans’ Federation, mass organizations, the Secretariat and Committees of the Provincial People’s Assembly, local administrative authorities, enterprises, and social organizations using state assets and budgets;
3. Head of the organization under inspection refers to the head of the organization responsible for and directly managing the entity under inspection;
4. State agency refers to the National Assembly, Provincial People’s Assembly, the President, the Government, local administrative authorities, People’s Courts, People’s Procuratorates, and other state organizations;
5. Inspection based on audit results refers to inspection conducted in necessary or urgent circumstances upon the request of the state audit agency, or inspection conducted after the adoption of audit results pursuant to a resolution of the National Assembly or a resolution of the Provincial People’s Assembly;
6. Inspection team refers to a team appointed by state inspection agencies at various levels to inspect specific subjects;
7. Special case inspection team refers to a team appointed by an authorized organization, operating based on resolutions, decisions, orders, or notifications, involving multiple relevant departments to carry out inspections;
8. Ministerial level refers to ministries, agencies, the Secretariat and Committees of the National Assembly;
9. Provincial level refers to provincial departments, agencies, the Secretariat and Committees of the Provincial People’s Assembly;
10. Officially authorized person refers to an individual, legal entity, or organization appointed or authorized to perform a specific public duty, or to enter into contracts involving state assets and budgets.
