Article 1

Purpose. This Decision stipulates the compensation policies, principles, regulations, conditions, methods, and unit prices for compensation regarding properties affected by the improvement and rehabilitation project of the southern route of National Highway 13 in Bolikhamxay Province, in compliance with laws and regulations, aiming to protect the legitimate rights and interests of the people, ensure equality, transparency, fairness, and verifiability; and to contribute to development and construction in accordance with the strategic plans of Bolikhamxay Province for each period.

Article 2

Compensation Policy and Compensation Unit Prices. The compensation policy and compensation unit prices for properties affected by the Improvement and Rehabilitation Project of National Highway No. 13 South, i.e., the conditions and unit prices for determining compensation for affected persons in the Improvement and Rehabilitation Project of National Highway No. 13 South (Kilometers 21 to 71), in Nasai Village and Saysavang Village, Thapabat District (Kilometers 66 to 71), shall cover property including land area, buildings, and loss of income (opportunity cost).

Article 3

Definition of Terms. The terms used in this Decision shall have the following meanings: 1. National Road No. 13 South Improvement and Rehabilitation Project: refers to improving the road according to ASEAN highway standards, making it more resilient to climate change, enhancing road capacity, and achieving better quality than before; 2. Affected Person: refers to a natural person, legal person, or organization whose property is damaged due to development project activities; 3. Relocation: refers to moving part of the property or only the affected property from the affected area to an unaffected area; 4. Transitional Assistance for Affected Persons: refers to assistance provided by the project owner to affected persons—concerning houses and shops—during the transitional period when rebuilding houses or shops and unable to conduct business; 5. Lawful Land Use Right: refers to a natural person, legal person, or organization holding complete ownership documents in accordance with relevant laws; 6. Suburban Land Area: refers to the land area surrounding the urban center, with lower building density than urban areas, containing agricultural, handicraft, and secondary and tertiary industrial activities, and having more vacant land; 7. National Road: refers to roads connecting the capital to provincial capitals, between provinces, main strategic roads, concerning overall national interests, national defense, maintaining public order, and interstate interests, holding economic and social importance, and connecting to international border crossings and transnational links; 8. National Road Surface Reserve Area: refers to the delineation of the national road boundary, extending 25 meters (twenty-five meters) outward from the road centerline on both sides; 9. Special Assistance: refers to in-kind or cash assistance provided to affected persons classified as requiring relocation of houses and shops; 10. Income Loss: refers to income loss caused by business suspension during the project construction period; 11. Auxiliary Structures: refers to kitchens, eaves, shop eaves, bathrooms, car repair shops, fences, walls, sheds; 12. Public Utility Systems: refers to facilities providing necessary public service conveniences, such as: electricity, tap water, telephone, national trunk lines (optical cables), etc.
