Article 1
Purpose. This Decision stipulates principles, regulations, and measures regarding the establishment, business activities, management, monitoring, and inspection of fertilizer production factories and fertilizer products, in order to ensure compliance with factory technical standards, prescribed fertilizer production standards, and relevant laws and regulations, aiming to encourage and promote the construction of fertilizer production factories, improve the fertilizer production system to be effective, enhance production to meet standards with good quality, ensure sufficient supply of fertilizer to meet consumption, be safe for humans, animals, plants, and the environment, and contribute to the development of the economy and society in a green and sustainable direction.
Article 2
Management of fertilizer production factories. The management of fertilizer production factories refers to the management of their establishment and operational activities to ensure compliance with factory technical standards, as well as monitoring, tracking, and inspecting them to achieve efficiency.
Article 3
Interpretation of terms. The terms used in this Decision shall have the following meanings: 1. Fertilizer refers to substances containing chemical components essential for plant growth and yield increase, including three categories: inorganic or chemical fertilizer, organic fertilizer, and bio-fertilizer; 2. Chemical fertilizer refers to fertilizers composed of inorganic substances (synthesized or processed) containing single or multiple plant nutrients, such as nitrogen (N), phosphorus (P), and potassium (K); 3. Organic fertilizer refers to fertilizers derived from organic soil or plant and animal residues (such as agricultural residues, livestock manure, vermicompost) through technical processing procedures (composting or fermentation); 4. Bio-fertilizer refers to fertilizers produced by the proliferation of one or more living microorganisms capable of free nitrogen fixation, decomposing and solubilizing phosphorus and other plant nutrients, including plants, plant residues, and animal and plant remains, which can induce biological, chemical, and physical changes in the soil necessary for plant growth; 5. Chemical fertilizer production factory refers to a site that meets specified technical standards and engages in the production and business activities of chemical fertilizers, classified into three scales based on machinery power, number of workers, and production capacity: small, medium, and large chemical fertilizer production factories; 6. Fertilizer product refers to various types and kinds of fertilizers produced by the factory according to standard production processes; 7. Technical standards for chemical fertilizer production factories refer to standards concerning site selection, buildings, machinery and equipment, cleanliness, safety, hygiene, production processes, and factory environment; 8. Operator of a chemical fertilizer production factory refers to a person who intends to and has obtained a legitimate certificate for operating a chemical fertilizer production factory in accordance with laws and regulations; 9. Waste refers to substances generated during the construction, operation, and cessation of operation of the factory that cannot be reused, such as solid, liquid, and gaseous waste.
