Article 1
Purpose. This Decision stipulates principles, regulations, and measures concerning the management, administration, protection, development, use of water and water resources, prevention of flood damage, restoration of affected areas, and ensuring the sustainability of water quantity and water resource sources, and serves as a long-term and permanent basis for carrying out this specialized function.
Article 2
Water management for water, water resources, and water area land refers to the collection of data, registration, protection, water use permits, and tracking and inspection of water supply services, water resources, and water use for both surface water and groundwater, to ensure water use complies with relevant laws and regulations, aiming to reduce impacts on water quantity and quality. Water is a type of natural liquid resource, a primary resource, and the most important foundation for the survival of humans and animals and for maintaining the balance of ecosystems and biodiversity. Water resources are natural resources, including water, water sources, and living or non-living things within water sources, such as: plants, aquatic animals, soil, minerals, sand, silt, and various minerals. Water area land refers to land outside the water surface or surrounding water sources, located within other types of land, such as: wetlands, ponds, swamps, seasonally flooded grasslands, spring areas, land adjacent to water, land within water, newly formed land, land formed by river diversion or changes in water flow, etc. This applies whether naturally formed or artificially created, with permanent or temporary water accumulation or water flow.
Article 3
Interpretation of Terms. The terms used in this Decision shall have the following meanings: 1. Water Source: refers to places where water permanently or temporarily gathers, inhabits, stays, or flows, formed naturally or constructed artificially, existing on the surface, underground, and in the air; 2. Surface Water Source: refers to water on the earth's surface, such as rivers, streams, creeks, canals, ponds, swamps, channels, waterfalls, cave water, and fissure seepage; 3. Groundwater Source: refers to water underground in layers, pockets, veins, or mixed with soil, such as springs, wells, mineral water, artesian well water, and bottom seepage; 4. Atmospheric Water Source: refers to rainwater, hail, fog water, and dew; 5. Reservoir: refers to a system of water accumulation through digging ponds or damming streams and rivers to ensure sufficient water supply and storage, meeting the needs of daily life, agricultural production, natural environment, and social balance; 6. Catchment Basin: refers to all land, water areas, and forests from the water source to the river mouth with a watershed, where rainwater falls and converges to form a water source system, such as the Nam Tha River, Nam Thong River, Nam Fa River, Nam Nga River, Nam Fa River, Nam Ma River, Nam Long River, and other rivers; 7. Dam, Weir: refers to structures built by intercepting water flow or constructing reservoirs for power generation, irrigation, or other purposes; 8. Wastewater: refers to water containing pollutants exceeding standard values, or water whose quality has changed after use, such as domestic, agricultural, industrial, and other water; 9. Bank Erosion Prevention and Control: refers to preventing and containing bank erosion in catchment basins, reservoirs, and land adjacent to water; 10. Ecosystem: refers to the chain of positive and negative interconnections between naturally existing living and non-living things; 11. Wastewater Treatment Pond: refers to a pond that eliminates or destroys pollutants, causing them to disappear or remain minimally, meeting prescribed standards, and not causing pollution to the environment and society.
