Article 1
Purpose. This Decree stipulates the principles, rules, and measures concerning the management, monitoring, and inspection of dual-use items, aiming to encourage, promote the convenience, efficiency, and effectiveness of the aforementioned work, ensure safety and transparency, maintain stability and peace, align with regional and international standards, and contribute to the national economic and social development.
Article 2
Dual-Use Item Management. Dual-use items refer to goods and technologies that can be used for both civilian and military purposes and may be directly or indirectly used in the design, development, production, or use of weapons of mass destruction, or delivery systems for weapons of mass destruction. Dual-use item management refers to the organization and implementation of principles, rules, and measures related to the export, transit, and intermediary services concerning dual-use items.
Article 3
Definition of terms. The terms used in this Order shall have the following meanings: 1. Technology means knowledge used for the design, development, production, or use of dual-use items, encompassing software and technical data, such as blueprints, templates, drawings, layouts, formulas, tables, standards, engineering designs, manuals, and instructions, whether in printed or electronic form; 2. Weapons of mass destruction means nuclear weapons, chemical weapons, and biological weapons, as defined in relevant conventions to which the Lao People's Democratic Republic is a party; 3. Delivery systems for weapons of mass destruction means equipment or systems specifically designed to deliver weapons of mass destruction, such as missiles, rockets, and other delivery systems; 4. Dual-use item operator means an individual or legal entity engaged in export, transit, and brokering services related to dual-use items; 5. Export means the transportation of dual-use items out of the Lao People's Democratic Republic, including temporary export and the provision of technical professional assistance related to dual-use items; 6. Transit means the transportation of dual-use items from one country through the Lao People's Democratic Republic to a third country; 7. Brokering services related to dual-use items means activities conducted by an individual or legal entity within the territory of the Lao People's Democratic Republic to provide negotiation, procurement, or facilitation services for trade transactions of dual-use items from one country to another, regardless of whether such services occur inside or outside the territory of the Lao People's Democratic Republic; 8. License means a document issued by the Ministry of Industry and Commerce to an individual or legal entity, authorizing the export or transit of dual-use items according to the type, quantity, and destination country specified in the license; 9. Brokering service certificate means a document issued by the Ministry of Industry and Commerce to an individual or legal entity to certify and track brokering service activities related to dual-use items; 10. End-user certificate for dual-use items means a document certifying the detailed information and purpose of use of the end-user of dual-use items, confirmed by the management authority for dual-use items or the competent authority of the destination country importing such dual-use items.
