Article 1
Purpose. This Decree prescribes principles, regulations, and measures for imposing fines and taking other actions against violations of standards laws and regulations, serving as a basis for relevant enforcement officers to correctly, strictly, and uniformly penalize violators and take measures nationwide. It aims to legalize activities related to standards, ensure safety and fairness, protect the rights and interests of consumers and business operators, and contribute to the country’s economic and social development.
Article 2
Fines and Other Measures. Fines are financial measures imposed on persons who commit administrative violations (which do not constitute criminal offenses under relevant standards). Other measures are measures imposed on persons who commit administrative violations (which do not constitute criminal offenses under relevant standards), in addition to fines, such as suspension or revocation of certificates, recall, seizure, destruction, and return of products and goods.
Article 3
Definition of Terms. The meanings of terms used in this Decree are as follows: 1. Bar code: refers to a symbol composed of vertical lines, radio frequency, or code segments, representing numbers, which can be read by a barcode reader; 2. Quality mark: refers to a mark certifying that products and goods have passed inspection and have been confirmed for quality in accordance with regulations; 3. Accreditation mark: refers to a mark recognized by international organizations, used to confirm the competence of certification bodies, inspection bodies, testing laboratories, and calibration laboratories; 4. Non-destructive quality testing: refers to the testing of characteristics, performance, and defects present in materials, structures, and products and goods without damaging the appearance, dimensions, or performance of the tested item.
