Articles
Article 1
1. To elaborate, clarify, specify, and unify the implementation nationwide of Articles 6 to 17, Articles 35 to 40, Article 42, Article 51, and Article 59 of the Decree on Electronic Commerce, No. 296/Government Decree (April 12, 2021); 2. To provide guidance and supplementary explanations on the registration, confirmation of registration, and licensing management of e-commerce operations; 3. To promote the expansion and development of e-commerce operations, ensure fair competition, protect the rights and interests of operators and consumers, and contribute to the socio-economic development of the country.
Article 2
Registration of e-commerce business activities (Article 10 of the E-Commerce Decree). E-commerce registration refers to the act by which a natural person or legal entity operating e-commerce through their own electronic channels, or engaging in transactions on electronic markets and providing electronic market services, submits their information. Natural persons or legal entities already operating e-commerce through their own electronic channels, or engaging in transactions on electronic markets and providing electronic market services, must register with the Internal Trade Department for study, review, confirmation of registration, and permission for their e-commerce operations. This shall be done within ninety days from the effective date of this guiding regulation; those who fail to apply for an operating permit within this period shall be subject to measures in accordance with Article 59 of the E-Commerce Decree and relevant laws and regulations.
Article 3
Materials Required for E-Commerce Registration (Article 11 of the E-Commerce Decree). To confirm registration for e-commerce, the materials required for registration are listed separately according to different circumstances as follows: A. For business entities: 1) Application form filled in according to the format of the Internal Trade Department; 2) Copy of the enterprise registration certificate, except for business entities not required to register an enterprise; 3) Copy of the business license (for businesses requiring a license); 4) Copy of supporting documents for using payment services in the Lao People's Democratic Republic; 5) Two 2-inch (3x4) ID photos with a white background taken within three months; 6) If the applicant cannot personally handle the matter, submit a power of attorney. B. For individuals: 1) Application form filled in according to the format of the Internal Trade Department; 2) Copy of ID card or household registration booklet; 3) Proof of address; 4) Copy of supporting documents for using payment services in the Lao People's Democratic Republic; 5) Two 2-inch (3x4) ID photos with a white background taken within three months; 6) If the applicant cannot personally handle the matter, submit a power of attorney.
