Summary
This Agreement, issued by the Governor of Xayaboury Province pursuant to the Law on Local Administration, the Law on Disaster Management, and the Decree on the Disaster Management Fund, provides for the raising, revenue sources, management and use of the disaster management fund, relief targets and methods, organizational structure, prohibited acts, inspection, rewards and penalties, effective from March 22, 2023, and replacing the previous Agreement No. 676 of 2022.
Articles
Article 1
Purpose. This Agreement stipulates the principles, regulations, and measures concerning the management and use of the Disaster Management Fund, in order to raise funds from domestic and foreign individuals, legal persons, families, and organizations for emergency relief, repair of essential infrastructure, search, location, and rescue operations, to restore the lives of disaster-affected people to normalcy or improve them, and to contribute to the protection, construction, and development of Xayaboury Province.
Article 2
Disaster Management Fund. The Disaster Management Fund (abbreviated as "ກພບ") is a fund established by a state agency organization, aimed at raising and accumulating funds from various sources to have a budget for social assistance, ensuring relief aid and humanitarian efforts during emergency disaster response periods, and providing assistance to objects suffering from disaster losses.
Article 3
Interpretation of Terms. The terms used in this Agreement have the following meanings: 1. Fund refers to the accumulation of money and materials obtained from various sources for disaster work; 2. Management refers to the protection of money and materials for correct use according to objectives; 3. Disaster refers to a widespread severe harmful event caused by nature or humans, causing significant damage to the health, life, property, economy, infrastructure, and livelihoods of the public in the short and long term; 4. Emergency relief refers to urgent, immediate assistance given to persons suffering from a disaster; 5. Materials for relief refer to food rations, household items, clothing, structures, and occupational tools; 6. Fundraising refers to income obtained through announcements or distribution of material pledge cards issued by provincial leaders or disaster management committees at various levels; 7. Other income refers to income obtained from fundraising activities conducted in any form approved by leaders and disaster management committees at various levels.
