Summary
This Decree, issued by the Government of Laos, stipulates the principles, regulations, and measures for the management and supervision of environmental impact assessment, including screening and grouping of investment projects or business activities, preliminary environmental assessment and detailed environmental impact assessment, review committee and experts, social participation, environmental certification, environmental technical supervision and inspection, rights and obligations of parties, information disclosure, prohibited acts, management and inspection, and measures for handling violators. This Decree replaces the Decree of the same name No. 2 dated January 31, 2019.
Articles
Article 1
Purpose. This Decree prescribes principles, regulations, and measures for the management, supervision, and inspection of environmental impact assessment work, in order to ensure that such work is carried out correctly, transparently, and uniformly, aiming to prevent, mitigate, and resolve negative impacts on the environment, ensure reasonable compensation for damages, properly arrange housing and livelihoods, and restore and improve the lives of affected persons to be better than before, achieve maximum efficiency in the management and utilization of natural resources, safeguard the rights and interests of the State and the people, and contribute to the implementation of the national socio-economic development plan in a green and sustainable direction.
Article 2
Environmental Impact Assessment. Environmental impact assessment refers to the process of researching, surveying, analyzing data, and predicting the potential positive and negative impacts of investment projects or various business activities on the social and natural environment in the short and long term, while simultaneously determining appropriate methods and measures to prevent, avoid, and mitigate impacts on the environment. The results of the environmental impact assessment are one of the main conditions for approving investment projects or various business activities.
