Articles
Article 1
Purpose. This Agreement stipulates the principles, regulations, and measures for the management, supervision, and inspection of procurement-contracting work carried out with state funds within the education and sports sector, serving as a basis for management bodies at all levels to organize and carry out work in a unified and transparent manner, aiming to ensure the correct, efficient, and effective use of state funds.
Article 2
Procurement-Contracting in the Education and Sports Sector. Procurement-contracting in the education and sports sector refers to the use of state funds for construction, repair, goods supply, work services, and consulting services for various programs or projects, in accordance with the decentralized management of the education and sports sector, carried out in the form of procurement and contracting consulting using state funds, implemented lawfully and fairly.
Article 3
Definition of terms. The meanings of the terms used in this Agreement are as follows: 1. Project Management Committee refers to the committee or organization appointed by the project owner or the procurement-contracting party, responsible for managing and coordinating the implementation of procurement-contracting work using state funds; 2. Project owner refers to the ministry-level or organizational entity related to procurement-contracting work using state funds, in accordance with the decentralized management of the Ministry of Education and Sports; 3. Educational premises refer to venues for teaching, research, training, and practice, including national centers, schools, colleges, institutes, and universities, both on and off campus; 4. Consultant refers to an individual or legal person hired by the project owner under a contract to provide consulting services; 5. State funds refer to the state budget, including state funds, funds obtained by the state from non-repayable aid, and loans from foreign countries and financial institutions; 6. Individual or legal person refers to contractors, goods suppliers, work service providers, and consultants; 7. Procurement-contracting party refers to the ministry-level or local-level state management agency within the education and sports sector that conducts procurement-contracting using state funds; 8. Contractor refers to an individual or legal person hired or entrusted by the project owner under a contract to carry out construction or maintenance; 9. Goods supplier or work service provider refers to an individual or legal person that procures or supplies goods, or provides work services, to the procurement-contracting party under a contract; 10. Specialized technical personnel refers to technical personnel with direct professional skills in a specific category of goods, work services, construction-maintenance, or consulting services.
