Article 1
Investment Promotion. Investment promotion refers to the formulation of promotional policies, creating an environment and conditions favorable to investment in all aspects, enabling investors to conduct business operations conveniently, swiftly, transparently, fairly, and legally.
Article 2
Interpretation of Terms. 1. Investment means the contribution of capital, tangible assets, and intangible assets to conduct business activities in the Lao People’s Democratic Republic; 2. Investor means a domestic or foreign natural person or legal entity that invests within or outside the territory of the Lao People’s Democratic Republic in accordance with the law; 3. Concession Contract means a contract concluded between a natural person or legal entity and an authorized state agency, granting the right to operate or develop a project within the legal framework of the Lao People’s Democratic Republic; 4. Memorandum of Understanding means a record document concluded between a legal entity and an authorized state agency, granting the right to conduct a feasibility study of a project; 5. Management means management at the level of laws and regulations to ensure compliance by all parties; 6. Management Agency means administrative agencies established by hierarchy and interconnected; 7. Inspection Agency means internal inspection agencies and external inspection agencies; 8. Profit Tax means a direct tax levied on the profits of enterprises (including self-employed professionals engaged in production and business operations); 9. Zone 1 means poor, remote areas with economic infrastructure unfavorable for investment, comprising two districts, namely Ta Oy District and Sa Mouay District; 10. Zone 2 means areas with socio-economic infrastructure favorable for investment, comprising six districts, namely Toomlarn District, Vapi District, Lakhonepheng District, Khongxedone District, Lakhonpeng District, and Saravane District; 11. Provincial Investment Committee means the Provincial Investment Promotion and Management Committee.
Article 3
Policy on Investment Promotion and Management. The provincial administrative authority focuses on promoting investment from domestic and foreign economic sectors, by formulating policies to create an environment and provide favorable conditions in various aspects, mainly including: building infrastructure, providing necessary information and consultation, customs policies, tax policies, labor policies, granting land use rights, financing channels, implementing various freedoms, and recognizing and protecting ownership rights related to use rights, usufruct rights, inheritance rights, transfer rights, and other rights stipulated by law; encouraging investment in various sectors, business fields, and regions within the province, except for regions and businesses that endanger the stability and security of the nation and the province, cause serious impacts on the current and long-term environment, or harm public health and the fine national culture.
