Articles

Article 1

Water Use. Water use refers to the utilization of surface water and groundwater for a specific purpose, including water for residential consumption and domestic use, electricity generation, irrigation, industry, mineral extraction and processing, tap water production, recreation, sports and tourism, and other purposes, and also includes services related to water and water resources, and drilling or excavating groundwater for use for a specific purpose.

Article 2

Definition of terms. The terms used in this Decision have the following meanings: 1. Surface water source, refers to water located above the ground surface, mainly including rivers, streams, creeks, ditches, ponds, canals, lakes, floodplain wetlands, oxbow lakes, waterfalls, reservoirs, cave water, rock face drips, etc.; 2. Groundwater source, refers to water buried underground, occurring in layers, sheets, veins, or mixed with soil, mainly including well springs, artesian springs, mineral water, deep groundwater (artesian well water), subsurface flow, etc.; 3. Groundwater, refers to natural water located underground, such as: well springs, deep groundwater, artesian springs, subsurface flow, etc.; 4. Deep groundwater (artesian well water), refers to groundwater obtained by drilling or digging from an aquifer at a depth of fifteen meters or more below the ground surface, where the aquifer is a confined aquifer with soil layers and water-saturated impermeable rock layers; 5. Well spring water, refers to groundwater located in an unconfined aquifer that can be accessed by excavating to the aquifer; 6. Groundwater drilling or digging, refers to drilling or excavating the ground through soil layers to extract water for various purposes; 7. Groundwater well information collection, refers to the collection and compilation of well spring water and deep groundwater, including information on the location, coordinates, width, depth, water level, and groundwater quality of drilled or dug wells; 8. Project reservoir management plan, refers to the organization and implementation of work related to formulating reservoir safety measures, preventing erosion and collapse, floods and droughts, planting and restoring watershed protection forests, maintaining minimum flow, water quality management, protecting aquatic biodiversity, handling emergencies, and restoring and repairing existing damage, and coordinating with watershed management plans at all levels within its development scope; 9. Water meter, refers to a device for counting or measuring the amount of water used.

Article 3

Scope of Application. This Decision applies to individuals, legal entities, and organizations engaged in water use activities within the territory of the Lao People's Democratic Republic, including both domestic and foreign entities.
