Article 1
Purpose. This decision stipulates regulations and measures concerning the assessment of land prices for roads in various districts and zones of the 7 districts of Phongsaly Province, to serve as a basis for calculating land ownership transfer registration fees, land use rights change fees, and land income tax, in compliance with relevant laws and regulations, fulfilling rights and obligations to the state, and serving as a foundation for implementing the policy of transferring state land use rights to individual land use rights, aiming to ensure transparency, fairness, and to track and inspect the collection of land revenue, contributing to increased national budget revenue and economic-social development of Phongsaly Province.
Article 2
Land price valuation. Land price valuation refers to the determination of land values in each zone based on the characteristics of geographical location, infrastructure, and the level of socio-economic development at each stage.
Article 3
Definition of terms. The terms used in this Decision shall have the following meanings: 1. Land price assessment zone map: refers to an area delineated for assessing land prices, used to calculate land ownership change registration fees and use right change fees, land income tax, and to implement the policy of transferring state land use rights to others; each map covers the surveyed and demarcated boundaries of a district. 2. Land price assessment zone symbol: refers to international alphabetical letters serving as symbols for each district. 3. Land price assessment zone: refers to sub-areas within the district's land price assessment zone map, classified based on infrastructure characteristics into commercial service areas, residential areas, agricultural areas, and industrial areas, divided according to urban areas, city center ring zones, urban expansion areas, suburban areas, rural areas, and priority development areas (or according to each district's development and expansion plan), and indicated by symbols and sequential numbers. 4. Land valuation table: refers to land valuation units per square meter, determined after data collection, research, unanimous consultation among relevant departments, and approval by the district administrative authority, based on each assessment zone and the various types of roads on which the land plots are located. 5. Main road: refers to a road that carries the entire traffic flow of the city (including inbound and outbound traffic), designated as a main artery in the city plan, and shown in purple on the assessment zone map. 6. Connecting road: refers to a road that carries traffic flow from main roads and various types of city roads (such as residential areas, city center commercial areas, industrial areas, etc.) and connects them, as determined in the city plan, and shown in blue on the assessment zone map. 7. Branch road: refers to a road that disperses traffic flow among city lanes and alleys, connecting main streets and small lanes, designated as a branch road in the city plan, and shown in green on the assessment zone map. 8. Alley: refers to a small path that is undeveloped, inconvenient for passage, or where no road exists; such roads are not indicated by any symbol or color on the land price assessment zone map, nor are they shown on land titles.
