Article 1
(Amended) Purpose. This agreement stipulates the principles, regulations, and measures for the management of contract farming agricultural investment, ensuring such investment is legal and compliant, aiming to develop land, guarantee agricultural commercial production according to clean agriculture standards, and contribute to the socio-economic development of Bolikhamxay Province.
Article 2
(Amended) Definition of Contract-Based Agricultural Investment Management. This refers to the state's management of domestic and foreign individuals, legal entities, and investors, with the participation of agricultural land owners through contractual forms, whereby such owners obtain land use rights in accordance with the law and have their correctness verified by the court registration authority.
Article 3
(Amended) Definition of Terms. The terms used in this Agreement shall have the following meanings: 1. Agriculture: refers to cultivation, animal husbandry, and fisheries, to meet social food supply, serve as raw materials for industry and processing, and produce goods for domestic sale and export; 2. Investor: refers to domestic or foreign individuals and legal entities lawfully registered and operating in the Lao People's Democratic Republic; 3. Technical-Professional: refers to the control over the entire production process of a specific crop, from seed selection, soil, cultivation, animal husbandry, care, harvesting to processing, to meet established standards; 4. Standard: refers to the definition of specific characteristics for products, goods, services, the environment, and production processes related to output quality; 5. Clean Agricultural Production: refers to Good Agricultural Practices (GAP) and organic agricultural production systems. Good agricultural production must have methods to prevent or reduce the risk of hazards that may occur during production, harvesting, and post-harvest processes, while organic agricultural production practically does not use chemical fertilizers and chemical pesticides; 6. Environment: refers to all living and non-living things (such as humans, animals, plants, etc.) naturally occurring or caused by humans, located around a certain target, which are interrelated and have positive or negative impacts on the survival, production, stability, and development of humans and nature; 7. Individual Land Use Right: refers to the land use right of Lao citizens holding legal land titles; 8. Land Title: refers to the sole primary document evidencing land use rights; 9. Land Area Declaration Form: refers to the land survey and collection of statistical data on various land plots, to track dynamic changes in land use, serving as the basic data for issuing land titles and paying land use fees; 10. State Management: refers to the State approving, facilitating, following up, inspecting, and promoting in accordance with laws and regulations to achieve good results in commercial agricultural production; 11. Land Area: refers to land used by the people for agricultural production, for which use rights have been legally obtained (holding a land title) and land used according to customary practices under Article 130 of the (Amended) Land Law; 12. Labor: refers to the productive labor force of the people and technical personnel used for commercial agricultural production; 13. Capital: refers to funds used by investors for agricultural production; 14. Varieties: refers to seeds, cuttings, branches, tubers, seedlings, young animals, fish fry, etc., selected through a variety selection process as good breeds for planting and animal husbandry; 15. Production Factors: refers to materials, equipment, machinery, fertilizers, pesticides, vaccines, veterinary drugs, feed, and other items used in agricultural production; 16. Market: refers to places for selling products domestically and internationally.
