Provincial Order on Unlawful Use of Vehicles on Highways in Attapeu Province (Governor of Attapeu Province)

Article 1

[Basis] Article 20, Section 1 of the Local Administration Law (Amended) No. 68/ສພຊ (December 14, 2015) concerning the rights and duties of the Provincial Governor and Mayor of the Capital; — Pursuant to the Land Transport Law (Amended) No. 24/ສພຊ (December 12, 2012); — Pursuant to the Land Traffic Law (Amended) No. 23/ສພຊ (December 12, 2012); — Pursuant to the Land Traffic Rules Decree No. 615/ລບ (December 9, 2020); — Pursuant to the proposal letter of the Provincial Stability Command No. 473/ປກສຂ (March 21, 2022). For the purpose of controlling the passage and use of vehicles on roads to ensure convenience, safety, order, and regularity, enabling road vehicle users to correctly comply with road traffic rules, aiming to reduce traffic accidents, alleviate traffic congestion, protect the lives and property of individuals and the public, ensuring peace and safety, and contributing to the province's socio-economic development and national defense-stability, the Provincial Governor issues the following order: I. Any individual, legal entity, or organization using vehicles such as motorcycles or cars that have not yet been registered (licensed) shall send such vehicles to the relevant authorities for registration (licensing) to comply with regulations; II. For vehicles using license plates that are old, cracked, broken, damaged, with lost documents, or with unclear or worn letters or numbers, a report shall be submitted to the relevant authorities to arrange for compliance with regulations; III. Vehicles with all correct and complete documents but which have not yet undergone registration and licensing shall proceed to register with the Department of Public Works and Transport, then obtain license plates from the Provincial Transport Department, within no more than 15 days from the date of vehicle purchase; IV. Drivers of all types of vehicles traveling on roads must pay strict attention to strictly complying with traffic rules; V. Drivers of all types of vehicles must undergo traffic rules training and must hold a driver's license that complies with regulations according to the specifications of the vehicle they drive; VI. Drivers and rear-seat passengers of motorcycles must wear safety helmets each time they drive; drivers and passengers of cars must fasten seat belts each time; VII. Freight and passenger transport vehicles must strictly comply with the Land Transport Law; passenger transport vehicles shall carry passengers according to the approved number of seats; as for freight vehicles and vehicles transporting earth or minerals, they must have covers and be securely tied to ensure that items do not fall or scatter along the road, causing dirtiness, unsightliness, and making passage difficult and chaotic; VIII. Walking along roads and crossing roads within towns and cities shall be carried out as follows: — Walk on the path designated for pedestrians; if there is no sidewalk, walk along the left edge of the road to be able to see oncoming vehicles; — Cross roads only at designated locations with zebra crossing markings; IX. All types of vehicles traveling on roads must have their technical condition checked comprehensively according to the manufacturer's factory standards; X. Prohibitions for road vehicles: — It is prohibited for individuals, legal entities, or organizations to arbitrarily modify the technical condition or install modified parts on vehicles without permission; — It is prohibited for business operators and vehicle repair shops to illegally cooperate in modifying the technical condition or installing modified parts; — It is prohibited to use vehicles without documents or with license plates that do not match the vehicle documents, illegally on roads; — It is prohibited to use vehicles with incorrect or incomplete documents for transport business operations or to illegally travel on roads; — It is prohibited for drivers to drive vehicles without a driver's license or to hold a driver's license that does not match the type of vehicle; — It is prohibited for children under 9 years old to ride bicycles, and for children under 12 years old to ride electric scooters; — It is prohibited to engage in street racing, sounding loud horns, riding in groups, racing each other on roads, creating noise disturbing society; — It is prohibited to use mobile phones, watch television, pictures, VCDs, DVDs, or various electronic entertainment devices while driving; — It is prohibited for drivers to park vehicles on sidewalks, in areas with no-parking signs, in areas with no-parking markings, or illegally park near three-way or four-way intersections; — It is prohibited to create filth along roads, damage road ancillary facilities, damage traffic sign systems, or obscure traffic signs with any material so that drivers cannot see them; — It is prohibited to construct or extend buildings, structures, place goods for sale, or place other items within the road right-of-way area; — It is prohibited to engage in various activities on curves, narrow roads, or roadsides without parking areas, as these are dangerous and likely to cause traffic accidents; — It is prohibited to graze or leave various types of livestock unattended along roads; driving or migrating livestock along roads must be supervised and must comply with laws and regulations; XI. Measures against violators. Any individual, legal entity, or organization violating this order, causing damage to the state, society, or others, shall be dealt with by means of education, warning, or fines depending on the circumstances; for serious cases, criminal liability shall be pursued in accordance with laws and regulations; XII. Implementation. The Attapeu Provincial Stability Command and the Attapeu Provincial Department of Public Works and Transport are assigned to be responsible for implementation. Individuals, legal entities, and organizations, upon becoming aware of this order, shall proactively implement it to achieve good results; XIII. This order replaces Provincial Governor Order No. 659/ຈຂອປ (July 11, 2016) and takes effect from the date of signature. Provincial Governor (Signature: ເລັດ ໄຊຍະພອນ / Let Xayyaphon).
