Articles

Article 1

Purpose. This Decree stipulates the principles, regulations, and measures for the management and monitoring of property that has been seized, impounded, and confiscated to the State (including property placed under State management by court order), in order to protect, account for, register, manage, use, and sell such property in accordance with the law, aiming to protect the rights and interests of the State, as well as the lawful rights and interests of individuals, collectives, and organizations, to ensure social peace and orderly regulation, and to participate in the national socio-economic development.

Article 2

Property Subject to Seizure, Attachment, and Confiscation to State Ownership. Property subject to seizure or attachment refers to property for which the relevant law enforcement personnel have issued an order for seizure or attachment. Property confiscated to state ownership refers to property for which the People's Court has rendered a judgment confiscating such property to state ownership.

Article 3

Interpretation of terms. The terms used in this Decree shall have the following meanings: 1. Perishable property refers to property that is prone to decay, spoilage, or nearing its expiration date, which will cause damage, directly affecting value and the life, health, or environment of users, primarily daily necessities, consumer goods, meat, and vegetables; 2. Property difficult to preserve refers to property requiring caretaking, protection, or suitable storage premises, primarily livestock, high-value trees, means of transport, and cultural relics; 3. Property adjudicated by the court to be managed by the State refers to ownerless property or disputed property, adjudicated by the People's Court to be managed by the State, primarily cultural relics, land, and buildings; 4. Property auction refers to competition in price and quality among individuals, legal persons, or organizations regarding property delivered for auction sale; 5. Sealed property refers to movable property used for, derived from, related to illegal acts, or under dispute, detained by order of the relevant investigative-pretrial authorities, People's Procuratorates, and People's Courts; 6. Attached property refers to the prohibition of buying, selling, delivering, transferring, exchanging, pledging, mortgaging, guaranteeing, accessioning, destroying, or altering movable or immovable property (including bank deposit accounts) related to illegal acts or under dispute, by order of the relevant investigative-pretrial authorities, People's Procuratorates, and People's Courts; 7. Confiscation to State ownership refers to the taking of all or part of property into State ownership by court judgment; 8. Registration refers to recording information about property adjudicated by court judgment to be confiscated to State ownership through affixing marks, adding registration numbers, adding codes, and entering into the State asset management information system, for management and tracking inspection.
