Articles

Article 1

Purpose. This Decree prescribes principles, regulations, and measures regarding the establishment, operation, and management of industrial zones and industrial parks to attract domestic and foreign investment; by formulating incentive policies to establish and develop industrial zones and industrial parks, and to invest in and operate various types of factory projects, aiming to make investment convenient, rapid, and compliant, and in line with green-oriented development policies, safeguarding the interests of the State, the people, developers, and investors; while promoting production, supplying domestic consumption and export abroad, participating in socio-economic development, and generating revenue for the State budget.

Article 2

Industrial Zones and Industrial Parks. An industrial zone refers to an area of land reserved or designated for the establishment of industrial factories or other business activities serving industrial operations, and which has received official approval from the government. An industrial park refers to an area of land that has been developed with technical infrastructure systems, such as: road systems, drainage, waste treatment, flood control, electricity, water supply, telecommunications, buildings, warehouses, and other necessary facilities, to serve the operations of industrial factories.

Article 3

Interpretation of Terms. The terms used in this Decree shall have the following meanings: 1. Developer, means a legal entity licensed by the Government of the Lao People's Democratic Republic to invest in and develop the technical infrastructure system of an industrial park; 2. Investor, means an individual or legal entity that has obtained an investment license and registered an enterprise in accordance with the law, and lawfully engages in production, trade, and service businesses within an industrial park; 3. Other Convenience Facilities, means various business operations supporting investment in industrial parks, such as shops, accommodation premises, and other services; 4. Land Use Permit, means a document for the transfer of land use rights issued by the provincial or capital Department of Industry and Commerce, or the Industrial Park Administration Office, to an investor for a lease term; 5. One Hundred Percent Government Investment, means investment where the government provides all funds for the development of an industrial park, and the state organizes administrative management under the mechanisms for the establishment and development of industrial parks as prescribed by this Decree and relevant laws and regulations; 6. Joint Investment between the State and Domestic or Foreign Private Sectors, means the Government of the Lao People's Democratic Republic jointly investing with domestic or foreign investors in the development of an industrial park, with the rights and obligations of each party stipulated in a cooperation contract; 7. One Hundred Percent Private Investment, means investment in the development of an industrial park by domestic private entities, foreign private entities, or a joint venture between domestic and foreign private entities, excluding joint investment by the government.
