Article 1
Purpose: The issuance of this Decree aims to declare the establishment of a watershed protection forest for the Nam Sen 3 Hydropower Project, reclassifying a portion of the Nam Zong-Nam Yi National Production Forest (with a total area of 122,259 (one hundred twenty-two thousand two hundred fifty-nine) hectares) located in Xieng Khouang Province as the Nam Sen Headwaters Watershed Protection Forest, allocated to the Nam Sen 3 Hydropower Project, with an area of 13,523 (thirteen thousand five hundred twenty-three) hectares, hereinafter referred to as the "Nam Sen Headwaters Watershed Protection Forest."
The establishment of the Nam Sen Headwaters Watershed Protection Forest primarily aims at the following purposes: 1. To manage and protect forests, forest resources, aquatic and terrestrial wildlife species, and the headwater source areas of rivers, ensuring year-round water flow to sustainably supply water for electricity production of the Nam Sen 3 Hydropower Project; 2. To protect natural abundance, biodiversity, the environment, prevent soil erosion from flowing into the reservoir area, and preserve soil quality; 3. To protect the beauty of natural landscapes, serving as a place for recreation, tourism, scientific research, and as a source of native tree species for propagation and promotion; 4. To manage, protect, develop, and utilize forests through a participatory approach with the people, ensuring sustainable use of forest products without depletion and without affecting the forest structure.
Article 2
Scope of the Nam Sen Headwater Protection Forest: The scope of the Nam Sen headwater protection forest is based on a 1:100,000 scale topographic map, using meridians and parallels as references against the actual terrain, specifically: bounded by the ridge or watershed of the Nam Sen headwater, rivers, roads, and the lowest and highest elevation points, so that local authorities, down to the people of all ethnic groups, can be aware of it and collaborate in its management, protection, development, and sustainable use.
Article 3
Location, Area, and Boundaries: The Nam Sen Headwater Protection Forest is located in Khoun District and Hok District of Xieng Khouang Province, and Thathom District of Xaysomboun Province, situated between East Longitude 103°35′03″ and 103°43′18″, and North Latitude 19°03′47″ and 19°18′34″. The area of the Nam Sen Headwater Protection Forest is 13,523 (Thirteen Thousand Five Hundred Twenty-Three) hectares, of which: Khoun District accounts for 3,660 (Three Thousand Six Hundred Sixty) hectares, representing 27.07%, and Thathom District accounts for 279 (Two Hundred Seventy-Nine) hectares, representing 2.06%. The details of its boundaries are as follows: 1. The northern boundary lies within Hok District, adjacent to the Nam Song-Nam Nge National Production Forest; 2. The southern boundary lies within Thathom District, adjacent to the Nam Sen-Nam Phong National Protection Forest; 3. The eastern boundary lies within New Hok District, adjacent to the Nam Song-Nam Nge National Production Forest; 4. The western boundary lies within Khoun District, adjacent to the Nam Song-Nam Nge National Production Forest and agricultural land and other plots of the people.
