Articles

Article 1

Article 1 (Amended) Purpose
This Law prescribes the principles, regulations, and measures for the execution of court judgments, involving civil cases, civil compensation in criminal cases, fines, confiscation of property or confiscation of items, and reform through labor without deprivation of liberty, in order to ensure strict, correct, prompt, and uniform execution of court judgments nationwide, aiming to strengthen the authority of the state and the law, protect the rights and interests of the state, protect the legitimate rights and interests of individuals, collectives, and organizations, promote social peace, order, and justice, and effectively build a rule-of-law state.

Article 2

Article 2 (Amended) Enforcement of Court Judgments
Enforcement of court judgments refers to the activities by which the court judgment enforcement agency and/or the parties concerned correctly implement and bring into actual effect the orders, rulings, judgments, and verdicts of the court that have become final and legally binding as stipulated in Article 9 of this Law, in order to restore the rights and interests of the State, collectives, organizations, and individuals that have been infringed upon or lost.

Article 3

Article 3 (Amended) Interpretation of Terms
The terms used in this Law shall have the following meanings:
1. Court mediation record refers to a document evidencing the outcome of court mediation;
2. Economic dispute resolution outcome refers to an agreement reached by the parties during mediation, an agreement reached by the parties before an award, or an arbitrator’s ruling;
3. Domestic arbitrator award refers to an award made by an arbitrator or arbitral tribunal of an economic dispute resolution body in accordance with the Law on Economic Dispute Resolution of the Lao People’s Democratic Republic;
4. Judgment debtor refers to a person obligated to perform a certain duty under a court judgment;
5. Seizure of property refers to the impoundment of movable property as evidence pursuant to an order of an investigative authority, the People’s Procuratorate, the People’s Court, or the court judgment enforcement authority;
6. Freezing of property refers to the prohibition of sale, purchase, delivery, transfer, exchange, pawn, mortgage, guarantee, addition, repair, destruction, or alteration of movable or immovable property related to the case, including bank deposit accounts, pursuant to an order of an investigative authority, the People’s Procuratorate, the People’s Court, or the court judgment enforcement authority;
7. Confiscation of property refers to the uncompensated transfer to the State of all or part of the property of an offender pursuant to a court judgment;
8. Confiscation of objects refers to the transfer to the State or destruction of property or objects related to, used in, or derived from a crime pursuant to a court judgment;
9. Confiscation of money refers to money ordered to be confiscated to the State by a court judgment;
10. Suspension of enforcement of a judgment refers to the temporary cessation of enforcement of a court judgment, which shall be resumed upon the disappearance of the cause for suspension;
11. Modification of enforcement of a judgment refers to the alteration of part or all of the content of enforcement deemed incorrect or inconsistent with the court judgment or the law;
12. Revocation of enforcement of a judgment refers to the cessation of enforcement of a court judgment concerning court costs, fines, and/or confiscated money based on a court’s revocation judgment;
13. Cancellation of enforcement of a judgment refers to the complete annulment of past enforcement of a court judgment ab initio;
14. Advance enforcement refers to the enforcement of part of a judgment, based on a judgment of the court of first instance or appellate court, which is deemed urgently necessary and requires execution before the judgment or ruling becomes final.
