Article 1

Basis: National Investment Law No. 72/NA (December 15, 2015); Electricity Law No. 19/NA (May 9, 2017); Public Procurement Law No. 30/NA (November 2, 2017); Guidance on Implementation of the National Investment Law No. 0889/MPI (June 9, 2021); Decree on the Activities of the Ministry of Energy and Mines No. 624/PMO (October 22, 2021); Submission No. 1520 of the Department of Planning and Cooperation (December 28, 2021). Article 2

Purpose. This guideline elaborates on the implementation of certain provisions of the National Investment Law No. 72/NA (December 15, 2015), the Electricity Law No. 19/NA (May 9, 2017), and the State Capital Procurement Law No. 30/NA (November 2, 2017), serving as specialized guidance for reviewing state investment projects in the energy and mineral sector. It aims to provide principles and bases for reviewing state investment projects using 67 categories of state budget for infrastructure construction, repair, and equipment supply in the energy and mineral sector; to ensure consistent understanding across the entire sector, and to make project implementation transparent, fair, auditable, efficient, effective, and in compliance with relevant laws and regulations.

Article 3

Interpretation of Terms. The terms used in this guideline have the following meanings: 1. National investment projects in the energy and mining sector refer to projects using 67 categories of state budget for infrastructure construction, repair, and equipment supply in the energy and mining sector, approved by the National Assembly or the Provincial/Capital People's Assembly; 2. Project appraisal refers to evaluating the relevance, efficiency, effectiveness, impact, and sustainability of a project, and verifying the accuracy and completeness of project documents before considering the project for inclusion in the national investment plan; 3. Category I national investment projects refer to projects with a cost exceeding 400 billion (four hundred billion) kip or more, with an implementation period not exceeding seven years; 4. Category II national investment projects refer to projects with a cost exceeding 200 billion (two hundred billion) kip up to 400 billion (four hundred billion) kip, with an implementation period not exceeding six years; 5. Category III national investment projects refer to projects with a cost exceeding 100 billion (one hundred billion) kip up to 200 billion (two hundred billion) kip, with an implementation period not exceeding five years; 6. Category IV national investment projects refer to projects with a cost exceeding 20 billion (twenty billion) kip up to 100 billion (one hundred billion) kip, with an implementation period not exceeding four years; 7. Category V national investment projects refer to projects with a cost of 20 billion (twenty billion) kip or less, with an implementation period not exceeding three years; 8. Construction-related technical promotion projects refer to project management projects, survey and design projects, consultancy fees, compensation for obstacle removal and resettlement, and feasibility study projects (FS); 9. Non-construction-related technical promotion projects refer to training, scientific and technological research, production promotion projects, and the preparation of overall socio-economic development plans; 10. Infrastructure construction and repair projects refer to the construction and renovation of medium and low voltage power grids and transformer installation projects, building construction and repair projects, etc.; 11. Equipment supply projects refer to procurement projects for vehicles, specialized technical equipment and assets, specialized equipment and necessary furniture, etc., directly related to new construction projects.
