Articles

Article 1

Purpose. This Agreement elaborates and implements Item 7 of Article 45 of Decree No. 470/Government, dated December 27, 2019, on the Management of Land Vehicles, stipulating the division of rights and duties of the Industry and Trade sector in the management of land vehicles, enabling land vehicle enterprises and personnel performing actual work to understand the roles and responsibilities of management agencies at all levels, aiming to facilitate the establishment and operation of land vehicle enterprises.

Article 2

Classification of Land Vehicle Business Management. The management of land vehicle business is classified into three levels, as follows: First, the central level, including the Import-Export Department, the Domestic Trade Department, and the Industry and Handicraft Department, with management responsibilities divided by type of land vehicle business, as follows: 1.1 The Import-Export Department is responsible for and leads coordination with relevant agencies in managing the import and export business of land vehicles; 1.2 The Domestic Trade Department is responsible for and leads coordination with relevant agencies in managing the sales business of land vehicles; 1.3 The Industry and Handicraft Department is responsible for and leads coordination with relevant agencies in managing the manufacturing and/or assembly business of land vehicles. Second, the provincial level, i.e., the Provincial and Capital Departments of Industry and Trade, which are responsible for and lead coordination with relevant agencies in managing land vehicle business within the province or Vientiane Capital, according to their functions. Third, the district level, i.e., the District and City Offices of Industry and Trade, which are responsible for and lead coordination with relevant agencies in managing land vehicle business within the district or city, according to their functions.

Article 3

Rights and Duties of the Import-Export Department. The Import-Export Department has the following rights and duties: 1. To study and formulate policies, regulations, and measures concerning the management, monitoring, and inspection of activities of business operators engaged in the import and export of land vehicles, and submit them to higher authorities for consideration; 2. To comprehensively publicize and disseminate to relevant central and local state agencies and the business community the policies, regulations, and measures concerning the management of import and export of land vehicles; 3. To consider issuing, suspending, or revoking import-export business licenses for land vehicles of four wheels or more (including two-wheeled or three-wheeled vehicles affiliated with companies importing or exporting vehicles of four wheels or more), with nationwide scope; 4. To consider applications for the import, export, and re-export of land vehicles, and notify the financial department for its information; 5. To coordinate with relevant agencies to study and report to the Minister of Industry and Trade, for submission to the Government for consideration, the determination and adjustment of business operators engaged in the import and export of land vehicles to suit the socio-economic development conditions in each period; 6. To receive, consider, resolve, or submit to higher authorities for consideration the proposals of business operators engaged in the import and export of land vehicles; 7. To summarize and report on the implementation of the management of import and export of land vehicles, together with statistics on the number of business operators, the number of vehicles imported for sale, the number of vehicles exported, and the number of vehicles re-exported, and submit periodic reports to higher authorities; 8. To exercise other rights and perform other duties in accordance with laws and regulations.
