Summary
The Governor of Phongsaly Province issues an order requiring all provincial departments, units, enterprises, and citizens to submit contracts and various documents to the judicial authority (deed registration agency) for legal verification, to improve the quality of deed registration, protect the legitimate rights and interests of all parties, and replace the former Order No. 07 of 2011.
Articles
Article 1
Instructing all departments, equivalent-level agencies, the Lao Front for National Construction organizations, mass organizations, the People's Army – Public Security Command, district governors, the Secretariat of the Provincial People's Council, state enterprises, as well as all fellow citizens and residents within Phongsaly Province, to submit contracts and various documents to the Provincial Department of Justice (Deed Registration Office) or the District Justice Office (District Deed Registration Unit) for legal correctness verification, in order to be considered lawful, compliant, and legally effective contracts or documents, primarily including:
1.1 Various types of contracts, such as: concession contracts, construction contracts, sales contracts, loan contracts, lease contracts, transport contracts, partnership contracts, property delivery contracts, labor contracts, etc.;
1.2 Contracts and legal acts concerning the change of land use rights and the transfer of land use rights, such as: inheritance of property by law and by will, sales contracts for land use rights, exchange contracts, pledge (mortgage-sale) contracts, contribution of land and houses as shares, compulsory acquisition of property in necessary circumstances, confiscation of property, property delivery – property transfer (involving land), lease contracts, guarantee contracts, succession of rights (in lease, guarantee, and pledge-sale contracts), orders for execution of court judgments, etc.;
2.3 Wills, ownership of joint marital property or original property, copies of documents, signatures or fingerprints, translations, comparison of individuals with photographs, dates of document confirmation, receipt of documents related to confirmation, and other documents.
Article 2
Individuals, legal entities, and organizations submitting contracts and various documents to the deed registration agency for legal correctness verification shall pay fees and service charges in accordance with the Deed Registration Law and the decrees issued by the President of the State in each period.
Article 3
The Provincial Justice Department and the Justice Offices of all districts within the province must strengthen attention, widely and deeply propagate and disseminate the Deed Registration Law and laws and regulations related to deed registration work, and proactively follow up, promote, inspect, and coordinate with various departments to achieve practical results, and regularly report to the provincial level for information and guidance.
