Articles

Article 1

The issuance of import licenses for all types of tractors under tariff heading 8701 of the Customs Tariff of the Lao People's Democratic Republic, specifically dedicated to agricultural production, is abolished. This tariff heading includes ride-on tractors and walk-behind tractors (walking-type tillers) operated by a driver following behind. Their importation must comply with the conditions stipulated in this Directive, as follows: 1.1 For the importation of ride-on tractors, an import permit for technical motor vehicles and a license for registration in the Lao People's Democratic Republic must be obtained from the Department of Transport, Ministry of Public Works and Transport, before customs import duty declaration can be made at the customs checkpoint, and importation must be conducted exclusively through international border checkpoints; 1.2 For the importation of walk-behind tractors (walking-type tillers) operated by a driver following behind, customs import duty declaration can be made directly at the customs checkpoint without the need to obtain an import permit for technical motor vehicles and a license for registration in the Lao People's Democratic Republic from the Department of Transport, Ministry of Public Works and Transport, and importation may be conducted through local border checkpoints, traditional border checkpoints, and international border checkpoints; 1.3 For all types of tractors dedicated to agricultural production, if imported by a farming household specifically for its own agricultural production, each household may import one tractor, subject to a certificate issued by the village administrative authority of the household's place of residence, certifying that the importation is for the purpose of the household's own agricultural production; if imported by a production group or cooperative, a certificate issued by the district or municipal agriculture and forestry office of the production group's or cooperative's location is required, certifying that the importation is for the use of that production group or cooperative and that the quantity imported is commensurate with the actual production area; 1.4 For tractors, parts, and accessories dedicated to agricultural production, if imported for domestic sale, the importing entity must be a business unit holding an enterprise registration certificate, providing after-sales service, and holding a wholesale and retail business license (for foreign investors), and importation must be conducted exclusively through international border checkpoints.

Article 2

The Department of Import and Export is assigned to take the lead, in coordination with relevant agencies, to publicize and organize the implementation of this Directive to achieve high effectiveness.

Article 3

This Instruction shall take effect fifteen days after the date of its signing and publication in the Official Gazette, and shall replace Instruction No. 0807/DOI dated September 2, 2021, on the Cancellation of Issuance of Import Licenses for Tractors.
