Articles
Article 1
Preferential origin certificate. A preferential origin certificate refers to a certificate proving that the goods originate from or have undergone production and processing in the Lao People's Democratic Republic, in order to apply for trade preferential treatment in accordance with the conditions of the origin rules of the preference-granting country. If the importing country granting trade preferences does not require a certificate of origin, the company/factory, producer, or exporter is not required to apply for a certificate of origin. The applicant for a preferential origin certificate refers to the company/factory, producer, exporter, or authorized agent. The preferential origin certificate includes two steps, namely: applying for a determination of origin, and applying for a preferential origin certificate, details as follows.
Article 2
Application for Confirmation of Product Originality (COS). The Confirmation of Product Originality is a document certifying that goods originate from or have been produced in the Lao People's Democratic Republic and fully meet the conditions of preferential origin rules. Issuance of the Confirmation of Product Originality serves as the basis for applying for a Preferential Certificate of Origin and must be issued for all goods to be exported using the Preferential Certificate of Origin, regardless of whether the goods are wholly obtained or produced using domestic materials in Laos (Wholly Obtained or Produced Goods) or not wholly obtained or produced using domestic materials in Laos (Not Wholly Obtained or Produced Goods).
Article 3
Documents Attached to Application for Certificate of Origin. An applicant for a preferential certificate of origin may apply to the competent authority for preferential certificates of origin nationwide for the determination of the origin of goods, and shall attach the following documents: 1) An application form in the format prescribed by the Import-Export Department; 2) Import Invoice; 3) A certification letter regarding the details of the goods, production process, costs and prices, as well as a production process flow chart, in the format prescribed by the Import-Export Department; 4) Documentary evidence of the acquisition or import of raw materials; 5) Annual export capacity declaration form; 6) Company signature specimen declaration form in the format prescribed by the Import-Export Department; 7) Copy of the enterprise registration certificate and relevant business license; 8) Copy of the annual tax obligation fulfillment certificate.
