Article 1
Purpose. This Agreement stipulates regulations, methods, and measures concerning the management, monitoring, and inspection of the business and use of chemicals under the Montreal Protocol and equipment containing such chemicals, in order to control, reduce, and cease the use of chemicals that impact the ozone layer. The aim is to prevent ozone layer depletion and the increase in the Earth's surface temperature, restore the ozone layer, reduce impacts on the life and health of humans, animals, plants, other living organisms, and ecosystems, and participate in economic and social development in a sustainable green direction.
Article 2
Management of Chemicals under the Montreal Protocol. The management of chemicals under the Montreal Protocol refers to the implementation of measures to control the operation and use of such chemicals, ensuring compliance with technical specifications to safeguard safety for health, life, property, the environment, and society.
Article 3
Interpretation of Terms. 1. Chemicals under the Montreal Protocol means controlled chemicals under that Protocol, existing as single chemical substances or as components of mixtures, containing ozone-depleting substances (ODS) — which, when released into the atmosphere, destroy the ozone layer and affect the rise in Earth’s surface temperature, as well as chemicals that cause global warming (greenhouse effect chemicals that affect global temperature rise); 2. Montreal Protocol means the international environmental protocol to which the Lao People’s Democratic Republic has acceded as a Party, whose purpose and objective are to reduce and cease the use of chemicals that destroy the ozone layer, reduce the use of hydrofluorocarbons (HFCs), restore the ozone layer through the promotion of alternative chemicals, and reduce impacts on the life and health of humans, animals, plants, other living organisms, and ecosystems; 3. Equipment containing chemicals under the Montreal Protocol means equipment containing chemicals for various purposes, such as refrigeration equipment, air conditioners, fire extinguishing systems, and fire extinguishers; 4. Quantity of chemicals means the quantity of chemicals permitted for import or export in accordance with the annual import quantity plan for chemicals under the Montreal Protocol; 5. Operation of chemicals under the Montreal Protocol and equipment containing such chemicals means activities involving the import, export, sale, service, storage, transport, and use of such chemicals and equipment containing such chemicals; 6. Particles means units used to refer to small or smallest parts, such as electrons, molecules, atoms, neutrons, and protons; 7. Global warming potential means the potential to cause global warming over a one-hundred-year period, calculated based on the radiation of carbon dioxide (CO2) that causes the greenhouse effect; 8. Counterfeit chemicals under the Montreal Protocol means chemicals whose name, mark, or appearance is identical or similar to registered chemicals under that Protocol, but with different characteristics or different mixture components; 9. Substandard chemicals under the Montreal Protocol means chemicals of poor quality, containing impurities, or whose components do not conform to the characteristics of registered chemicals as prescribed by that Protocol.
