Articles

Article 1

To provide a basis for management agencies of court judgment enforcement in monitoring, inspection, and guidance; to provide a basis for court judgment enforcement agencies in guiding enforcement personnel in the valuation, sale, and transfer of property, ensuring openness, correctness, and compliance with laws and regulations; to ensure a unified understanding and perception of enforcement work among court judgment enforcement personnel and relevant parties.

Article 2

1. Meaning of property: Property in the execution of court judgments under this Directive refers to movable and immovable property, including both property serving as collateral and non-collateral property.
2. Meanings of terms used in this Directive:
- Collateral property: Refers to various types of property owned by the plaintiff, defendant, third party, individual, legal person, or organization, which, in accordance with orders, final rulings, final and effective court judgments or decisions, or rulings or judgments subject to provisional execution, are agreed to be provided to the creditor as security to ensure the performance of a contract or the satisfaction of a debt;
- Non-collateral property: Refers to various types of property proven to be owned or acquired by the person subject to execution, which the person subject to execution is currently possessing or using, or which, pursuant to an obligation, has been transferred to the possession or use of another person, legal person, or organization, and which has been discovered, registered, seized, or attached by the enforcement officer;
- Property belonging to the debtor or person subject to execution: Refers to various types of property proven to be owned or acquired by the person subject to execution, which the person subject to execution is currently possessing or using, or which, pursuant to an obligation, has been transferred to the possession or use of another person, legal person, or organization;
- Property acquired under authorization from the property owner: Refers to property granted to the person subject to execution by an individual, legal person, or organization pursuant to an obligation, but which has not yet been registered under the name of the person subject to execution.
